Warranty of Customer. In the event of legal claims of third parties or authorities based on data, content, or the resources provided by Cus- tomer (in particular, software licences), Customer shall indemnify Swisscom, ensure an appropriate defence against such claims, and cover the costs of such defence. Should Swisscom have well-founded doubts as to the lawfulness of a planned or actual use of the services pro- vided by Swisscom, including the systems operated or supplied by it, then Swisscom may suspend the affected service or take other suitable measures without owing R compensation, even if this conflicts with Swisscom’s duty of performance under the individual contracts. In this event, Swisscom shall inform Customer immediately.

Warranty of Customer. (a) Customer shall indemnify and hold harmless SF&E from any loss, liability, or expense arising out of an actual or alleged infringement of any patent, trademark, or other proprietary right relating to the manufacture and sale of products manufactured in accordance with patterns, designs, alloy specifications, or design information supplied by Customer.
Warranty of Customer. Customer represents and warrants that DSM’s Manufacture of Product hereunder in accordance with the Manufacturing Process and other technology, each to the extent provided by Customer to DSM does not infringe or conflict with any patent or other proprietary right of any third party and there is no claim or basis therefor that might impair the use of such inventions and/or rights by DSM to Manufacture Product.

EXCEPT FOR THE LIMITED WARRANTY SET FORTH ABOVE, SELLER MAKES NO WARRANTY WHATSOEVER, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR AGAINST INFRINGEMENT. IN THE EVENT WARRANTIES EXIST AT LAW THAT MAY NOT BE DISCLAIMED, PURCHASER AGREES THAT SUCH WARRANTIES SHALL BE LIMITED IN DURATION TO THE ONE YEAR WARRANTY PERIOD AND TO THE REPLACEMENT VALUE OF THE PRODUCT.
