Weight Measurement. The weight of coal sold hereunder shall be determined on Buyer's certified track scales at the Danskammer Plant, which scales shall be maintained and certified in accordance with the provisions of the U.S. Department of Commerce National Bureau of Standards Handbook 44. If such scales are inoperative at the time of any coal delivery, the weight of coal shall be the weight as determined by Seller's batch weighing system at the High Power Mountain loadout.

Weight Measurement. The weight of coal sold hereunder shall be determined by an Independent Marine Survey(s) of the Vessel averaged between Load and Discharge Port or only the Load Port weight if Discharge Port option is not elected. Weight Measurement. Scales (full truck scales only) are required for measurement of rock to be mined and placed. Contractor is responsible for maintaining all gravel or dirt roads needed by Contractor to obtain access to or from the work sites. Contractor will be fully responsible for all acts and omissions of its subcontractors and of persons directly or indirectly employed by them and of persons for whose acts any of them may be liable to the same extent that he is responsible for the acts and omissions of persons directly employed by him.
