Common use of Without Clause in Contracts

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, in any of the situations referred to in that paragraph suffer losses in the territory of the other Contracting Party resulting from: a) Requisitioning of their investment or part thereof by the latter's forces or authorities, or b) Destruction of their investment or part thereof by the latter's forces or authorities, which was not required by the necessity of the situation, Shall be accorded restitution or compensation which in either case shall be prompt, adequate and effective.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, who in any of the situations referred to in that paragraph suffer losses in the territory area of the other Contracting Party resulting from: (a) Requisitioning requisitioning of their investment or part thereof property by the latter's its forces or authorities, ; or (b) Destruction destruction of their investment or part thereof property by the latter's its forces or authorities, authorities which was not caused in combat action or was not required by the necessity of the situation, Shall ; shall be accorded restitution or compensation which in either case reasonable compensation. Resulting payments shall be prompt, adequate and effectivein a freely convertible currency.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, in any of the situations referred to in that paragraph suffer losses in the territory of the other Contracting Party resulting from: a) Requisitioning of their investment or part thereof by the latter's forces or authorities, orOr b) Destruction of their investment or part thereof by the latter's forces or authorities, which was not required by the necessity of the situation, Shall be accorded restitution or compensation which in either case shall be prompt, adequate and effective.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, in any of the situations referred to in that paragraph paragraph, suffer losses in the territory of the other Contracting Party Party, resulting from: a) Requisitioning of their investment or part thereof property by the latter's its forces or authorities, or b) Destruction of their investment or part thereof property by the latter's its forces or authorities, which was not caused in combat action or was not required by the necessity of the situation, Shall shall be accorded by the latter Contracting Party restitution or compensation which in either case shall be prompt, adequate and effective.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, in any of the situations referred to in that paragraph paragraph, suffer losses in the territory of the other Contracting Party resulting from: (a) Requisitioning requisitioning of their investment property by its military or part thereof by the latter's forces or civil authorities, ; or (b) Destruction destruction of their investment or part thereof property by the latter's its forces or authorities, which was not caused in combat action or was not required by the necessity of the situation, Shall shall be accorded restitution or compensation which in either case adequate compensation. Resulting payments shall be prompt, adequate and effectivefreely transferable.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, in any of the situations referred to in that paragraph suffer losses in the territory of the other Contracting Party resulting from: (a) Requisitioning requisitioning of their investment or part thereof by the latter's forces or authorities, or (b) Destruction destruction of their investment or part thereof by the latter's forces or authorities, which was not required by the necessity of the situation, Shall shall be accorded restitution or compensation which in either case shall be prompt, adequate and effective.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, who in any of the situations referred to in that paragraph suffer losses in the territory of the other Contracting Party resulting from: (a) Requisitioning requisitioning of their investment or part thereof property by the latter's its forces or authorities, ; or (b) Destruction destruction of their investment or part thereof property by the latter's its forces or authorities, which was not caused in combat action or was not required by the necessity of the situation, Shall ; shall be accorded restitution or compensation compensation, which in either case shall be promptadequate, adequate effective and effectivepaid within a reasonable time. Resulting payments shall be freely convertible.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, who in any of the situations referred to in that paragraph suffer losses in the territory of the other Contracting Party resulting from: (a) Requisitioning requisitioning of their investment or part thereof property by the latter's its forces or authorities, ; or (b) Destruction destruction of their investment or part thereof property by the latter's its forces or authorities, which was not caused in combat action or was not required by the necessity of the situation, Shall ; shall be accorded restitution or compensation which in either case reasonable compensation. Resulting payments shall be prompt, adequate freely convertible and effectivetransferable.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, in any of the situations referred to in that paragraph suffer losses in the territory of the other Contracting Party resulting from: a) Requisitioning requisitioning of their investment or part thereof by the latter's forces or authorities, orOr b) Destruction destruction of their investment or part thereof by the latter's forces or authorities, which was not required by the necessity of the situation, Shall shall be accorded restitution or compensation which in either case shall be prompt, adequate and effective.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, in any of the events/situations referred to in that paragraph paragraph, suffer losses in the territory of the other Contracting Party resulting from: a) Requisitioning : - requisitioning of their investment or part thereof property by the latter's forces or authoritiesauthorities of the other Contracting Party, or b) Destruction or - destruction of their investment or part thereof property by the latter's forces or authoritiesauthorities of the other Contracting Party, which was not caused in combat action or was not required by the necessity of the situation, Shall shall be accorded restitution or adequate compensation in no less favourable than that, which in either case shall would be prompt, adequate and effectiveaccorded under the same circumstances to an investor of the other Contracting Party or to an investor of any other State.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, in any of the situations referred to in that paragraph whose investments suffer losses in the territory of the other Contracting Party resulting from: (a) Requisitioning requisitioning of their investment or part thereof property by the latter's forces or authoritiesauthorities of the latter Contracting Party, or (b) Destruction destruction of their investment or part thereof property, by the latter's forces or authoritiesauthorities of the latter Contracting party, which was not caused in combat action or was not required by the necessity of the situation, Shall be accorded restitution or such compensation which in either case shall as may be prompt, adequate and effectiveprescribed by the laws of the latter Contracting Party.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, in any of the situations referred to in that paragraph paragraph, suffer losses in the territory of the other Contracting Party resulting from: a(i) Requisitioning requisitioning of their investment or part thereof property by the latter's forces or authoritiesauthorities of the other Contracting Party, or b(ii) Destruction destruction of their investment or part thereof property by the latter's forces or authoritiesauthorities of the other Contracting Party, which was not caused in combat action. or was not required by the necessity of the situation, Shall shall be accorded restitution fair and adequate compensation for the loss suffered during the requisitioning or compensation which in either case shall be prompt, adequate and effectiveresulting from the destruction of their properties.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, in any of the situations referred to in that paragraph paragraph, suffer losses in the territory of the other Contracting Party resulting from: a) Requisitioning requisition of their investment or part thereof property by the latter's forces or authoritiesauthorities of the other Contracting Party, or b) Destruction destruction of their investment or part thereof property by the latter's forces or authoritiesauthorities of the other Contracting Party, which was not caused in combat action or was not required by the necessity of the situation, Shall be accorded restitution shall be, without delay, provided fair and adequate compensation for the losses suffered during the requisition or compensation which in either case shall be prompt, adequate and effectiveresulting from the destruction of their properties.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, who in any of the situations referred to in that paragraph suffer losses in the territory of the other Contracting Party resulting from: a) Requisitioning of their investment or part thereof property by the latter's its forces or authorities, or, b) Destruction of their investment or part thereof property by the latter's its forces or authorities, which was not caused in combat action or was not required by the necessity of the situation, Shall be accorded restitution or compensation which in either case adequate compensation. Resulting payments shall be prompt, adequate and effectivefreely transferable in any convertible currency.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, in during any of the situations referred to events specified in that paragraph this paragraph, suffer losses in the territory of the other Contracting Party resulting fromarising out of: a(A) Requisitioning the requisitioning of their investment or part thereof property by the latter's its forces or authorities, authorities or b(B) Destruction the destruction of their investment or part thereof property by the latter's their forces or authorities, which was not caused by military actions, or not required by the necessity needs of the situation, Shall Fair and adequate compensation will be accorded restitution or compensation which in either case shall be prompt, adequate and effectiveprovided.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, in any of the situations referred to in that paragraph suffer losses in the territory of the other Contracting Party resulting from: (a) Requisitioning of their investment or part thereof property by the latter's its forces or authorities, ; or (b) Destruction of their investment or part thereof property by the latter's its forces or authorities, which was not caused in combat action or was not required by the necessity of the situation, Shall ; shall be accorded restitution or compensation which in either case shall be prompt, adequate and effectivecompensation.”.233

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, who in any of the situations referred to in that paragraph suffer losses in the territory of the other Contracting Party resulting from: a) Requisitioning of their investment or part thereof property by the latter's its forces or authorities, or b) Destruction of their investment or part thereof property by the latter's its forces or authorities, authorities which was not caused in combat action or was not required by the necessity of the situation, Shall be accorded restitution or compensation which in either case shall be prompt, adequate appopriate fair and effectivenondiscriminatory compensation.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, who in any of the situations referred to in that paragraph suffer losses in the territory area of the other Contracting Party resulting from: (a) Requisitioning of their investment or part thereof property by the latter's its forces or authorities, ; or (b) Destruction of their investment or part thereof property by the latter's its forces or authorities, authorities which was not caused in combat action or was not required by the necessity of the situation, ; Shall be accorded restitution or compensation which in either case reasonable compensation. Resulting payments shall be prompt, adequate and effectivein a freely convertible currency.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, in any of the situations referred to in that paragraph paragraph, suffer losses in the territory of the other Contracting Party Party, resulting from: a) Requisitioning of their investment or part thereof property by the latter's its forces or authorities, or b) Destruction of their investment or part thereof property by the latter's its forces or authorities, which was not caused in combat action or was not required by the necessity of the situation, Shall be accorded by the latter Contracting Party restitution or compensation which in either case shall be prompt, adequate and effective.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, who in any of the situations referred to in that paragraph suffer losses in the territory of the other Contracting Party resulting from: (a) Requisitioning requisitioning of their investment or part thereof property by the latter's its forces or authorities, or (b) Destruction destruction of their investment or part thereof property by the latter's its forces or authorities, which was not caused in combat action or was not required by the necessity of the situation, Shall shall be accorded restitution or compensation which in either case adequate compensation. Resulting payments shall be prompt, adequate and effectivefreely transferable in any convertible currency.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, in any of the events/situations referred to in that paragraph paragraph, suffer losses in the territory of the other Contracting Party resulting from: a) : - Requisitioning of their investment or part thereof property by the latter's forces or authoritiesauthorities of the other Contracting Party, or b) or - Destruction of their investment or part thereof property by the latter's forces or authoritiesauthorities of the other Contracting Party, which was not caused in combat action or was not required by the necessity of the situation, Shall shall be accorded restitution or adequate compensation in no less favourable than that, which in either case shall would be prompt, adequate and effectiveaccorded under the same circumstances to an investor of the other Contracting Party or to an investor of any other State.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, who in any of the situations referred to in that paragraph suffer losses in the territory of the other Contracting Party resulting from: a) Requisitioning of their investment or part thereof property by the latter's its forces or authorities, or b) Destruction of their investment or part thereof property by the latter's its forces or authorities, authorities which was not caused in combat action or was not required by the necessity of the situation, Shall Xxxxx be accorded restitution or compensation which in either case shall be prompt, adequate appopriate fair and effectivenondiscriminatory compensation.

Without. prejudice to paragraph 1 of this Article, investors of one Contracting Party who, in any of the situations referred to in that paragraph whose investments suffer losses in the territory of the other Contracting Party resulting from: (a) Requisitioning requisitioning of their investment or part thereof property by the latter's forces or authoritiesauthorities of the latter Contracting Party, or (b) Destruction destruction of their investment or part thereof property, by the latter's forces or authoritiesauthorities of the latter Contracting party, which was not caused in combat action or was not required by the necessity of the situation, Shall Xxxxx be accorded restitution or such compensation which in either case shall as may be prompt, adequate and effectiveprescribed by the laws of the latter Contracting Party.
