Personal Necessity. A maximum of eight (8) days of accumulated sick leave may be used in any school year for personal necessity leave for any of the following reasons:
Personal Necessity. A member may use up to eight (8) days per year of sick leave earned under Item 7.1.1 of this article, at his/her election, for absences caused by personal necessity. Personal Necessity is defined as an emergency or personal matters which require the member to be absent from work during his/her regular work hours and which cannot be accomplished during the member’s non-work hours. The member will give his/her supervisor 24 hours notice regarding such absences, except in a case of an emergency. In an emergency when a member cannot give 24 hours notice, or when a supervisor has reasonable cause to question the validity of an absence, the supervisor may require the member to provide information as to the nature of the absence. In claiming personal necessity, the member is certifying that such leave was not used for any of the following:
Personal Necessity. Any days of leave for illness or injury may be used by unit members, at their election, in cases of personal necessity. Unit members shall not be required to secure advance permission for leave taken for any of the following reasons:
1. Death or serious illness of a member of the immediate family.
2. Accident, involving their person or property, or the person or property of a member of the immediate family. A maximum of seven (7) days of accumulated leave may be used in any school year for the purposes enumerated above. Unit members must obtain advance permission prior to taking such leave except in those situations specifically enumerated in this section. Personal necessity leave shall not be taken for the purpose of personal business which can be attended to during non-duty hours; a strike or any other activities related to a work stoppage; or extension of a holiday or vacation period. (If directly adjacent to a holiday or the winter or spring vacation period, specific reasons are required.) Unit members may not be prohibited from using personal necessity leave to observe major religious holidays. If the District has reason to believe that this section has been violated, it may request verification. Two (2) of the seven (7) personal necessity days may be taken without prior approval from the District, provided that, in addition to the above requirements, all the following conditions are met:
1. The unit member must give the District office at least three (3) working days notice prior to the leave day.
2. No more than two (2) unit members per school may be absent on such leave during any one (1) duty day.
Personal Necessity. Except where otherwise provided, an employee may use as many as seven (7) days of accumulated sick leave in any fiscal year for instances of personal necessity for the following reasons:
Personal Necessity. Death of a member of the employee’s immediate family, as defined in the Bereavement Leave Section, when additional leave is necessary.
Personal Necessity. Up to 7 days annually, taken from sick leave. If no sick leave available – 100% pay deduction.
Personal Necessity. Employees may use up to seven (7) days of accumulated sick leave per fiscal year in the cases of personal necessity, including any of the following: (1) death of a member of the immediate family when leave beyond normal bereavement leave is required; (2) accident to the person or his property or the person or property of the immediate family; (3) appearance in any court or administrative tribunal as a litigant, party, witness, or under an official order; (4) serious or critical illness of a member of the immediate family; (5) death of sister-in-law or brother-in-law; (6) other personal contingency that requires an employee's absence from duty. The words "emergency" and "contingency" are used to mean an event "out of the ordinary", i.e., an act of God or circumstances beyond one's control; (7) an occasion that cannot be covered in the normal course of events. Any four (4) of the seven (7) days of authorized Personal Necessity Leave are designated "No Tell Days" and may be utilized for reasons of compelling personal importance at any time during the school year. When possible, the unit member will secure at least two (2) days advance approval for such leave from his/her immediate administrator. Proof of personal necessity shall be submitted to the Director of Human Resources, within two (2) days of the employee's return to duty and shall include (1) dates of absence, and (2) reason for absence, in enough detail to determine a clear case of personal necessity. Personal time off in a day, not exceeding two (2) hours and not covered by necessity leave may be made up during the same working day in which the absence occurred. Such make up time must have prior authorization from the immediate supervisor and administrator responsible for that department.
Personal Necessity. 1. Any bargaining unit member may elect to use any days of full pay sick leave earned pursuant to the section “Disability – Sick Leave”, below, not to exceed a total of seven (7) days in any school year in cases of “personal necessity.”
2. Up to three (3) days of the seven (7) days of personal necessity leave may be used by a unit member for reasons that the unit member considers to be a “personal necessity.” For the remaining four (4) days of personal necessity leave, “personal necessity” shall be used only in the situations which meet one of the following conditions:
(a) is emergency in nature;
(b) arises from factors outside of the ability of the bargaining unit member to control;
(c) cannot reasonably be handled at times outside the bargaining unit member’s work day;
(d) twenty-four (24) hours of personal necessity leave as determined by the bargaining unit member which may be taken in four (4) hour increments. In all circumstances, personal necessity may not be used for the extension of a holiday or vacation.
3. Bargaining unit members must obtain twenty-four (24) hours’ advance permission from the CEO or his/her designee prior to taking any personal necessity leave, except for personal necessity leave taken for the reasons enumerated below:
(a) death of a member of their immediate family when additional leave is required beyond that provided in the section on Bereavement Leave, above;
(b) accident involving their person or property or the person or property of a member of their immediate family;
(c) appearance in any court or before any administrative tribunal as a litigant, party or witness under subpoena or any order made with jurisdiction.
4. For the purpose of personal necessity leave, the term “members of the immediate family” shall have the same meaning as provided in the section on Bereavement Leave above, in addition to including aunt(s), uncle(s), niece(s), and nephew(s).
Personal Necessity. In case of personal necessity, a member of the unit may draw on accumulated sick leave not to exceed seven (7) days in any fiscal year for any one or any combination of the following purposes:
a. Additional days beyond the three (3) or five (5) of bereavement leave granted in paragraph 10.4, or for bereavement of a relative not covered under paragraph 10.4.
b. Accident involving the employee's person or property or the person or property of the employee's immediate family.
c. Appearance in court or before an administrative tribunal as a litigant.
d. Religious holidays other than legal holidays on the Board-adopted calendar.
e. Imminent danger to his/her home occasioned by an event such as flood or fire, serious in nature, which under the circumstances the employee cannot reasonably be expected to disregard, and which requires the attention of the employee during his/her assigned hours of service.
f. Such other reasons as approved by the District.
10.5.1 Two (2) of the seven (7) personal necessity days may be used at the employee’s discretion without prior approval.
Personal Necessity. 9.4.1 Unit members are entitled to seven (7) days of Personal Necessity Leave (EC 44981), earned under Article 9.2 – Illness/Disability, and may be used at the unit member’s election for the purposes identified below, with the site administrator’s verification of no adverse impact on students. The unit member will submit via the online absence management system the request at least 24 hours in advance of taking leave except in the case of an emergency. Days used under this section will be deducted from the unit member’s earned sick leave balance.
9.4.1.1 Leave to attend the funeral of other than immediate family as defined in Section 9.3.2;
9.4.1.2 Additional bereavement leave;
9.4.1.3 Accident involving unit member’s person or property or the person or property of a unit member’s immediate family;
