Personal Necessity Leave. Unit members shall be entitled to use up to seven (7) days of paid sick leave in each school year in cases of personal necessity defined below. Unit members may use one (1) of the seven (7) annual days on a confidential basis for a reason set forth in paragraphs A through F below. The unit member shall be required to certify that he/she used the confidential day for a reason specified in subsections A-F, but shall not be required to state, with respect to the confidential day, which of the subsections applies. Personal necessity leave may be utilized by an employee who has sufficient sick leave credit for circumstances which are serious in nature which cannot be expected to be disregarded, and which necessitate immediate attention, and cannot be dealt with during off-duty hours. The employee shall submit a request for personal necessity leave approval on an Agency form to the immediate supervisor not less than five (5) working days prior to the beginning date of the leave. The prior approval requirement shall not apply to leave for purposes set forth in paragraphs A, B, and D. However, when prior approval is not required, the employee shall make every reasonable effort to comply with Agency procedures designed to secure substitutes, and shall notify the immediate supervisor of the expected duration of the absence. The Agency reserves the right to review each request and to verify such request by any appropriate means.
A. For purposes of this subsection only, death of a member of the immediate family, including registered domestic partners is defined as mother, father, step-parents, husband, wife, son, daughter, step-children, brother, sister, mother-in-law, father-in-law, son-in-law, daughter-in- law, brother-in-law, sister-in-law, grandmother, grandfather, grandson, granddaughter, aunt, uncle, niece, or nephew of the unit member.
X. An accident involving the person or property of the unit member or of a member of the member's immediate family, including registered domestic partners, as defined above. The accident must be of such an emergency nature that the immediate presence of the unit member is required during the regular workday.
C. Appearance in court as a litigant, or as a witness under order of subpoena.

Personal Necessity Leave. A unit member may use up to eight (8) days of accumulated full-salary sick leave benefits described in Section 10.2. in any school year in the following cases of personal necessity:
Personal Necessity Leave. 7.8.1 Leave which is credited under Section 7.2 of Article 7 (Illness and Injury Leave) may be used, at the member’s election, for purposes of personal necessity, provided that use of such personal necessity leave does not exceed seven (7) days in any school year. The unit member shall give the site administrator 24-hour advance notice of such leave and duration of such leave, to the extent that emergencies beyond control do not preclude such notice. This leave does not require advanced permission.
7.8.2 For the purpose of this provision, Personal Necessity Leave shall be limited to:
(a) death or serious illness of a bargaining unit member of the member’s family or any person living in the immediate household of the bargaining unit member
(b) an accident which is unforeseen involving the bargaining unit member’s person or property, or the person or property of a bargaining unit, member’s immediate family, or any person living in the immediate household of the bargaining unit member
(c) appearance in any court or before any administrative tribunal as a litigant, party, or witness under subpoena or any order made with jurisdiction or
(d) unavoidable or indispensable personal matters, except for matters which can be taken care of outside work hours Personal necessity leave will not be granted for purposes of (a) employee organization (as defined in Government Code Section 3540.1) business or activity; (b) work stoppage, work slowdown or strike; (c) any concerted activity that interferes with the efficient operation of the District; (d) personal convenience or routine, personal activities; (e) vacation, holiday, recreation or social activities, or (f) any activity which results in compensation, income or financial gain to be accrued by a member of the bargaining unit or by a member of the immediate family. The member shall make a reasonable effort to comply with District procedures to enable the District to secure a substitute. The statement of absence completed by the member shall verify that the personal necessity leave was used only for purposes set forth in this section. The member’s signature on the Statement of Absence form (Appendix D) verifies the personal responsibility for which the leave was taken could not have reasonably been fulfilled during hours when the member was not assigned to work.

Personal Necessity Leave. Each full time permanent or probationary worker shall be granted up to a maximum of 40 hours of paid leave per year for reasons of genuine personal necessity. Workers who work fewer than 40 hours per week are entitled to that proportion of personal leave granted full- time workers that is equal to the percent of a full-time contract. Each classified hourly employee shall be granted up to 3 days of paid leave per year on a pro-rata basis. Eligibility for personal necessity leave begins on the first of the calendar month following six complete months of employment. For the purpose of this section "personal necessity" means obligations or unavoidable duties of an individual worker that must be performed during regularly scheduled working hours. The number of hours of leave remaining will appear on the check stub each month. Circumstances under which personal necessity leave is appropriate include, but are not limited to:
10.10.1 Emergencies or obligations related to the worker's home or family members, including medical or dental appointments for the worker's family members when the nature of the appointment requires the worker's presence, or special family obligations such as attending a family member's graduation or marriage ceremony;
10.10.2 Emergencies or obligations related to the worker, including appointments for the purpose of conducting personal legal affairs or financial transactions, receipt of a court order requiring absence from work, or observation of a major religious holiday of the worker's faith. Personal necessity leave may not be used for recreation, planning a vacation, or social events, nor may it be used in lieu of vacation or sick leave (except after an illness of 10 working days or more and no full-pay sick leave is available, a worker may use personal necessity leave.) Unless there are unavoidable and compelling reasons (i.e., medical appointments or illness after being on extended sick leave) personal necessity leave may not be taken in conjunction with any holiday, sick leave, vacation, or other leave of absence. When advance scheduling is not possible because of an emergency situation, the worker is required to notify the supervisor as soon as possible that the worker is requesting personal leave. Personal Necessity Leave. Employees may use up to ten (10) days of accumulated sick leave during any school year in case of personal necessity. Personal necessity is defined as any activity or personal obligation of an employee which necessitates or mandates his/her absence from his/her assignment during the work hours.
7.5.1 The employee shall not be required to give advance notice for leave taken for any of the following reasons:
a. Death or serious illness of a member of his/her immediate family.
b. Accident involving his/her person or property or the person of a member of his/her immediate family.
7.5.2 Advance notice is required for, but not limited to, the following acceptable reasons. The employee's application to use sick leave for personal necessity must be received by the Head Start Director not less than three (3) working days prior to the desired absence.
a. Appearance in court as a litigant or as a witness under official order.
b. Response to an official order from another governmental jurisdiction for reasons not brought about through the connivance or misconduct of the employee of such emergency nature that the presence of the employee is required during his/her working hours and no alternative meeting time during non-duty hours can be arranged.
c. Settling of legal affairs and other serious personal emergencies which cannot be resolved on a non-working day, if approved by the Employer or its designee.
d. Seeing a son, daughter, spouse, or parent off to military duty.
e. Funerals.
f. Extensions of bereavement leave.
7.5.3 No more than one (1) day of personal necessity will be approved for the following in any school year. (Not less than three (3) working days advanced notice and supervisory approval is required.)
a. Attendance at or participation in functions or activities, which are primarily for the employee’s pleasure, amusement, or personal convenience.
b. The extension of holidays or vacation periods for personal convenience.
c. Accompanying a spouse on a trip when such travel is not otherwise authorized by these rules.
7.5.4 Personal necessity will not be approved including but not limited to the following reasons:
a. Seeking or engaging in remunerative employment.
b. Engaging in a strike, demonstration, picketing, lobbying, rally, march, campaign meeting, or any other activities related to work stoppage or political campaigning.
c. Religious or non-school conference.
Personal Necessity Leave. 11.2.9.1 A maximum of seven (7) workdays of accumulated, full-salary sick leave credit per fiscal year may be used for any of the following:
11.2.9.1.1 Death or serious illness of a member of the immediate family as defined in Article 11.
1. In the case of illness, there must be a need for the services of a physician and the immediate presence of the employee.
11.2.9.1.2 Accident involving the employee's person or property, or that of his/her immediate family as defined in Article 11.1.
11.2.9.1.3 Appearance in court as a litigant, or as a witness under an official order.
11.2.9.1.4 Personal observances or events which are of such significance that to be absent from duty is a personal necessity.
11.2.9.2 Absences for personal necessity may be taken in increments of one
(1) hour, and shall not be granted during a scheduled leave of absence.
11.2.9.3 Applications for personal necessity leave are to be submitted in writing to the site administrator five (5) working days in advance. In an emergency, (a personal event which an employee could not plan and had no control) applications for personal necessity may be made orally to the immediate supervisor and, upon return to duty, a completed application for benefits, prescribed and provided by the District, shall be filed.
Personal Necessity Leave. An employee may be granted a maximum of seven (7) days leave of absence in any school year without loss of pay, in cases of personal necessity. Such leaves shall be deducted from the employee’s accumulated sick leave.
Personal Necessity Leave. A faculty member cannot be required by management to supply a specific reason when using personal necessity leave.
12.3.1 A unit member shall be granted a maximum seven (7) days leave of absence in any school year without loss of pay in cases of personal necessity. Such leave shall be deducted from the employee's accumulated sick leave.
12.3.2 Personal necessity is the illness or death of a member of the immediate family (not covered by Family Leave or Bereavement Leave), an accident involving the member's person or property or the person or property of a member of the immediate family; appearance in court as a litigant or as a witness under official order; or, compelling personal business which cannot be conducted before or after the employee's regular assigned duty day. Personal necessity leave is not intended for vacation. Reasonable notice in advance is required, where possible, and, District approval must be obtained prior to the leave payment being processed.
12.3.3 Immediate family" shall be as defined in "Bereavement Leave."
Personal Necessity Leave. (a) An employee may be absent from duty without loss of pay for up to seven (7) duty days during any fiscal year and have the absence charged to the employee’s accrued sick leave account.
(b) For the purpose of qualifying for paid personal necessity leave, there shall be a compelling reason which required the employee’s absence from duty, which cannot be attended to outside of duty hours, and which shall be limited to one of the following reasons:
(1) An accident involving the employee’s person, property, or the person or property of an employee’s immediate family (as defined in Section 2(c) of this Article) not otherwise chargeable to any other paid leave of absence for which the employee qualifies.
(2) The required appearance of the employee brought about as the result of a legal notice to appear as a witness before a governmental or judicial agency or court of law.
(3) The illness of a member of the employee’s immediate family (as defined in Section 2 (c) of this Article) including the birth of a child to the employee.
(4) Any imminent danger as the result of flooding or fire or similar natural catastrophe to the personal residence of the employee.
(5) The death of a member of the employee’s immediate family (as defined in Section 2 (c) of this Article) when additional leave is required beyond that provided in Section 2 of this Article.
(6) Up to 2 personal necessity days may be used for religious observance.
(7) Other reasons submitted in writing and approved in advance by the Xxxx, Director or Manager.
Personal Necessity Leave. 13.2.1 A maximum of seven (7) days of sick leave may be used by an employee in any school year for personal necessity, for the following purposes:
