Witness Service. 1. When an employee is under subpoena as a witness in connection with his official duties or is under subpoena as a witness in a court proceeding in which the employee is not a part to the litigation, he/she shall be eligible for Temporary Duty Elsewhere leave and shall receive regular compensation while on witness duty and shall remit to the Board in check or money order (no cash) the amount of fees, less travel allowance and other expense allowances, received for witness duty. 2. Before compensation is approved, the employee shall provide the supervisor with the witness duty subpoena, a copy of which shall be attached to the request for Temporary Duty Elsewhere leave. 3. An employee who is a party to litigation may request either personal leave charged to sick, personal leave without pay or annual leave (if applicable).
