Common use of Work Related Personal Injury Clause in Contracts

Work Related Personal Injury. Whenever a bargaining unit member is absent from school as a result of a personal injury incurred in the course of employment for the Kearsarge Regional School District that is adjudged compensable under Worker’s Compensation Law and the employee receives payment for lost wages under the Workers’ Compensation Law, the employee will keep those payments as provided by the District’s Workers’ Compensation Carrier. The absences shall be recorded as ‘other’ paid leave and shall not be deducted from the employee’s sick leave. In the event that the employee does not receive compensation for lost wages under the Workers’ Compensation Law, the absences shall be deducted from the employee’s available leaves, including paid sick leave. In the event sick leave is deducted during the pendency of a worker’s compensation claim, such leave will be returned to the employee when the claim is approved.

The District then shall pay the employee $100% of gross pay (minus deductions), and the absences shall be recorded as ‘other’ paid leave and shall not be deducted from the employee’s sick leave. In the event that the employee does not receive compensation for lost wages under the Workers’ Compensation Law, the absences shall be deducted from the employee’s available leaves, including paid sick leave. In the event sick leave is deducted during the pendency of a worker’s compensation claim, such leave will be returned to the employee when the claim is approvedapproved and the employee signs payments for lost wages over to the District.
