PERSONAL INJURY BENEFITS. A. 1. Whenever a teacher is absent from duty as a result of personal injury caused by an accident or an assault and/or battery upon the teacher arising out of and in the course of employment, the teacher will be paid full salary (less the amount of any worker's compensation paid for said injury) for the period of such absence not to exceed 189 working days.

PERSONAL INJURY BENEFITS. Whenever a teacher is absent from school because of personal injury resulting from an assault occurring on school property or at a school-sponsored event and suffered in relation to the performance of a responsibility or assigned duty, the teacher will be paid full salary less the amount of any worker’s compensation or disability insurance received due to such injury until the termination of the employment contract or the end of the school year, whichever occurs first. No part of such covered absence will be chargeable to annual sick leave. The board shall, however, have the right to have the teacher examined by a physician designated by the board for the purpose of establishing the length of time the teacher may be absent, and the board shall make its decision on the basis of the professional opinion of said physician. The board, in its discretion and upon investigation of all facts of the incident, shall provide such support as is statutorily permissible for any assault upon a teacher acting in the discharge of official school duties.
PERSONAL INJURY BENEFITS. Whenever a Teacher is absent from school as a result of personal injury caused by an accident occurring in the course of his/her employment, he/she will be paid his/her full salary, less the amount of any workmen's compensation award made for temporary disability due to said injury. For the first thirty (30) work days, no part of such absence will be charged to his/her accumulated sick leave. Thereafter, the teacher may elect to use accumulated sick time or the sick leave bank (if eligible) to make up the difference between any workers’ compensation and his/her full salary. For injuries resulting from assault or which are construction related, a teacher will be paid his/her full salary, less the amount of any workmen's compensation award made for temporary disability due to said injury and no part of such absence will be charged to his/her accumulated sick leave.
PERSONAL INJURY BENEFITS. Section 1 Absence as a Result of Injury Whenever a teacher is absent from school as a result of an injury arising out of or in the course of employment, and has not been retired, the teacher shall be eligible to file a claimfor workers’ compensation benefits. A teacher who is absent from school as a result of such injury and subsequently becomes eligible for workers’ compensation benefits may use accumulated sick leave to cover the difference between the teacher’s full salary and any workers’ compensation award made for lost income resulting from said injury for the period of such absence and until any previously accumulated sick leave is exhausted. The exhaustion of accumulated sick leave available to such teacher shall not in any way impair the teacher’s eligibility for continued benefits from any workers’ compensation program and or award. This provision is to be limited to the extent that the COMMITTEE is required to pay for an additional period of time pursuant to the Workers’ Compensation Law less the amount of money due to the COMMITTEE as reimbursement under this Agreement.
Section 2 Medical, Surgical, Hospital Reimbursement The COMMITTEE shall reimburse a teacher for the full cost of medical, surgical, or hospital services (less the amount of any insurance reimbursement) incurred as the result of any injury sustained in the course of employment. This provision is to be limited to a maximum of three years from the date of injury, except to the extent that the COMMITTEE is required to pay for An additional period of time pursuant to the Worker's Compensation Law (less the amount of reimbursement due to the COMMITTEE under the terms of this Agreement).
PERSONAL INJURY BENEFITS. All personnel are covered by Workmen's Compensation for any accident occurring in the performance of their employment. Time covered by Workmen's Compensation is not deducted under Leave Policy.
PERSONAL INJURY BENEFITS. The Committee agrees that the provisions of Chapter 152, Section 69, General Laws of the Commonwealth of Massachusetts providing for benefits of employees or their dependents in the event of incapacity or death arising out of employment shall be accepted and applied to members. A teacher receiving Workers’ Compensation benefits for as long as the latter benefit payments continue, provided that the said difference shall be charged, on an appropriate proportional basis, against the sick leave benefits to which the said teacher may be entitled.
PERSONAL INJURY BENEFITS.
A. Teachers will be required to report all accidents suffered by them in connection with their employment to the appropriate authority within twenty-four (24) hours of said accidents.
B. 1. Whenever a teacher is absent from school as a result of personal injury caused by an accident or an assault occurring in the course of his/her employment, s/he will be paid his/her full salary (less the amount of any Workers Compensation award made for temporary disability due to said injury) for the period of such absence. The difference between the amount for Workers’ Compensation and the teacher’s full salary will ordinarily be charged to the teacher’s annual or accumulated sick leave. However, if the absence is due to a physical assault upon the teacher by a student or students which requires that the teacher seek medical attention, the teacher will not be charged for sick leave.
PERSONAL INJURY BENEFITS. A. Whenever a teacher is absent from school as a result of personal injury caused by an accident arising out of and in the course of his/her employment, he/she shall be paid compensation in accordance with the Workers' Compensation Law of the State of Connecticut.
B. If a teacher, absent and entitled to compensation under Section A of this Article, is not contributorily negligent with respect to the personal injury sustained by him/her, then, he/she shall be paid his/her full salary (less the amount of any Workers' Compensation payment or award) for the period of such absence up to a maximum of one hundred eighty (180) days following the date of injury.
C. The Board shall determine whether or not the teacher was contributorily negligent which determination shall be subject to the grievance procedure.
D. If a teacher so elects, payments of full salary may be continued for all periods of absence not compensated at full salary to the extent of the teacher's accrued unused sick leave. Accrued unused sick leave shall not be applied against any payments made pursuant to the Workers' Compensation Law of the State of Connecticut or any full salary paid pursuant to this Article.
E. A complete report of each accident shall be made to the Chief Human Resources Officer as soon as possible.
F. In connection with the payment of any compensation from the Board to an injured teacher under this Article, the Board and the injured teacher shall have the same rights and obligations to each other and with respect to third parties as Section 31-293 of the Connecticut General Statutes, as amended, gives an employer and employee under the Workers' Compensation Act.
PERSONAL INJURY BENEFITS. Whenever the Principal is absent from school as a result of personal injury caused by an accident or assault occurring in the course of her employment, she will be paid her full salary (less the amount of any workmen's compensation award made for temporary disability due to said injury) for the period of such absence. The difference in pay between workmen's compensation award and full pay will be charged off to the Principal's annual or accumulated sick leave.
