Common use of Working in a Higher Classification Clause in Contracts

Working in a Higher Classification. Any employee who is assigned duties of a higher job classification shall be paid the rate of pay equivalent to the step of the applicable range that equals at least 5% above their normal wage rate for work in the higher classification for each hour he or she performed such duties when the duties exceed forty (40) hours. When the employee exceeds the 40 hour requirement, he/she shall be paid the higher rate for the previous 40 hours worked. In the event the employee’s Out of Classification assignment creates a change to vacation accruals or the allowance of “annual leave”, the employee will be eligible for a prorated accrual amount, directly related to the duration in the Out of Classification assignment. This provision shall be limited to situations where the employee in the lower class is assigned all or most of the duties of the higher level position.
