Common use of Working on an ADO Clause in Contracts

Working on an ADO. (a) An Employee who works on an ADO shall be provided with an agreed day off in lieu in the same cycle or the following cycle. The day is to be determined before the ADO is worked. (b) Where the necessity to work an ADO is a result of an ‘emergency’ the agreement as to a day off in lieu may be reached subsequent to the working but is to be in the same or following cycle. (c) This sub-clause does not apply to train crew, on board services staff or operational wages Employees who are paid in accordance with excess Shifts principle. (d) If the Employer is unable to provide a day off in lieu then normal overtime rates shall apply.
