Xxxxxx of Negotiations. 1. During the term of this Agreement, the Board and OAPSE shall not be obliged to negotiate any subject matter, whether or not specifically referred to or covered in the Agreement, except as follows:
Xxxxxx of Negotiations. The Board and the Association acknowledge that during negotiations resulting in this agreement, each party had the right and the opportunity to make demands and proposals with respect to any matter that this agreement was arrived at by the parties after the exercise of that right and opportunity. The Board and the Association shall voluntarily waive, during the life of this agreement, said rights and each agrees that the other shall not be obligated to negotiate with respect to any subject or matter irrespective of whether such matters or subject are specifically referred to or covered in this agreement, even though such subject or matter may not have been within the knowledge or contemplation of either or both parties at the time negotiations were being conducted or at the time the party signed this agreement.
Xxxxxx of Negotiations. The parties waive their right to initiate negotiations with respect to any negotiable during the term of this agreement except as provided in Article I and Article XXIV, Management Rights.
Xxxxxx of Negotiations. During the negotiations leading to the execution of this Agreement, the Union has had full opportunity to submit all items appropriate to collective bargaining and the Union expressly waives the right to submit any additional item for negotiation during the term of this Agreement, irrespective of whether the item was or was not discussed during the course of negotiations leading to the execution of this Agreement. The specific provisions of this Agreement are the sole source of any rights which the Union or any employee may charge the Employer with violating in raising a grievance.
Xxxxxx of Negotiations. Neither the Association nor the Board waive any rights to bargain or refuse to bargain during the term of any Agreement with respect to wages, hours, terms and other conditions of employment except as may be expressly limited by Chapter 4117 of the Revised Code.
Xxxxxx of Negotiations. Each party waives the right and agrees that the other shall not be obligated to bargain collectively on any subject whether or not covered in this agreement during its term even though such subject may not have been within their knowledge or contemplation at the time they signed this agreement. This agreement may be amended only in writing and by mutual consent. This waiver does not apply to bargaining for a new agreement that would take effect after this agreement expires.
Xxxxxx of Negotiations. 1. The parties acknowledge that during the negotiations which resulted in this Agreement, each had unlimited right and opportunity to make demands and proposals with respect to any subject or matter not removed by law from the area of collective bargaining, including, but not limited to, any and all specifications pertaining to Ohio civil service laws or other provisions of the Ohio Revised Code, and that the understandings and agreements arrived at by the parties after the exercise of that right and opportunity are set forth in this Agreement. Therefore, each voluntarily and unqualifiedly waives the right, and each agrees that the other shall not be obligated during the term of this Agreement to bargain collectively with respect to any subject, specification or matter referred to, or covered in this Agreement, or with respect to any subject or matter not specifically referred to, or covered in this Agreement, even though such subjects or maters may have been within the knowledge or contemplation of either or both of the parties at the time they negotiated or signed this Agreement, and irrespective of whether the item was or was not discussed during the course of negotiations leading to the execution of this Agreement.

The Board and the WTA acknowledge that during negotiations resulting in this Agreement, each party had the right and the opportunity to make demands and proposals with respect to any matter and that this Agreement was arrived at by the parties after the exercise of that right and opportunity. The Board and the WTA shall voluntarily waive, during the life of this Agreement said rights and each agrees that the other shall not be obligated to negotiate with respect to any subject or matter irrespective of whether such matters or subject is specifically referred to or covered in this Agreement, even though such subject or matter may not have been within the knowledge or contemplation of either or both parties at the time negotiations were being conducted or at the time the party signed this Agreement.
Xxxxxx of Negotiations. Except as specifically provided in this contract, the board and the OTA waive the right to negotiate further with respect to matters specifically covered in this Agreement.
