Xxxxxx of Negotiations. 1. During the term of this Agreement, the Board and OAPSE shall not be obliged to negotiate any subject matter, whether or not specifically referred to or covered in the Agreement, except as follows:
2. The Board and OAPSE mutually agree to negotiate a subject or matter; and
3. The OAPSE may exercise any statutory right to request bargaining as to matters not covered by the Agreement if and when the Board determines to make a unilateral change in working conditions that is within the scope of bargaining.
Xxxxxx of Negotiations. The Board and the Association acknowledge that during negotiations resulting in this agreement, each party had the right and the opportunity to make demands and proposals with respect to any matter that this agreement was arrived at by the parties after the exercise of that right and opportunity. The Board and the Association shall voluntarily waive, during the life of this agreement, said rights and each agrees that the other shall not be obligated to negotiate with respect to any subject or matter irrespective of whether such matters or subject are specifically referred to or covered in this agreement, even though such subject or matter may not have been within the knowledge or contemplation of either or both parties at the time negotiations were being conducted or at the time the party signed this agreement.
Xxxxxx of Negotiations. The parties waive their right to initiate negotiations with respect to any negotiable during the term of this agreement except as provided in Article I and Article XXIV, Management Rights.
Xxxxxx of Negotiations. During the negotiations leading to the execution of this Agreement, the Union has had full opportunity to submit all items appropriate to collective bargaining and the Union expressly waives the right to submit any additional item for negotiation during the term of this Agreement, irrespective of whether the item was or was not discussed during the course of negotiations leading to the execution of this Agreement. The specific provisions of this Agreement are the sole source of any rights which the Union or any employee may charge the Employer with violating in raising a grievance.
Xxxxxx of Negotiations. Bargaining will be conducted from 9:30
a. m. to 4:30 p.m. Tuesday – Thursday of each week.
Xxxxxx of Negotiations. Except as specifically provided in this contract, the board and the OTA waive the right to negotiate further with respect to matters specifically covered in this Agreement.
Xxxxxx of Negotiations. The parties acknowledge that during the negotiations which resulted in this Agreement, each had the opportunity to make proposals, and that the understandings and agreements arrived at by the parties after the exercise of that opportunity are set forth in this Agreement. Therefore, for the life of this Agreement, the Board and the Association each voluntarily and unqualifiedly waive the right and each agrees the other shall not be obligated to negotiate with respect to any subject or matter referred to or covered in this Agreement and with respect to any subject matter not specifically referred to or covered in this Agreement, unless otherwise mutually agreed.

The Board and the WTA acknowledge that during negotiations resulting in this Agreement, each party had the right and the opportunity to make demands and proposals with respect to any matter and that this Agreement was arrived at by the parties after the exercise of that right and opportunity. The Board and the WTA shall voluntarily waive, during the life of this Agreement said rights and each agrees that the other shall not be obligated to negotiate with respect to any subject or matter irrespective of whether such matters or subject is specifically referred to or covered in this Agreement, even though such subject or matter may not have been within the knowledge or contemplation of either or both parties at the time negotiations were being conducted or at the time the party signed this Agreement.
Xxxxxx of Negotiations. Neither the Association nor the Board waive any rights to bargain or refuse to bargain during the term of any Agreement with respect to wages, hours, terms and other conditions of employment except as may be expressly limited by Chapter 4117 of the Revised Code.
