Xxxxxxx Act Assignment. 30 Developer shall assign to ADOT all right, title, and interest in and to all claims and 31 causes of action it may have under Section 4 of the Xxxxxxx Act (15 U.S.C. Sec. 15), 32 arising from purchases of goods, services or materials pursuant to the Contract 33 Documents or any Subcontract. This assignment shall become automatically effective 34 when ADOT tenders Final Payment to Developer, without further documentation or 35 acknowledgment by the Parties.

Xxxxxxx Act Assignment. DBT shall assign to KYTC all right, title, and interest in and to all claims and causes of action it may have under Section 4 of the Xxxxxxx Antitrust Act (15 U.S.C. Sec. 15), arising from purchases of goods, services or materials pursuant to the Contract Documents or any Subcontract. This assignment shall become automatically effective when KYTC tenders Final Payment to DBT, without further documentation or acknowledgment by the Parties.
