DBA Documents definition

DBA Documents means the documents listed in this Section 1.2. Each of the DBA Documents is an essential part of the agreement between the Parties, and a requirement occurring in one is as binding as though occurring in all. The DBA Documents are intended to be complementary and to describe and provide for a complete agreement.
DBA Documents has the meaning set forth in Section 1.2 of the Design-Build Agreement.

Examples of DBA Documents in a sentence

  • DB Contractor shall promptly notify TxDOT in writing of all Errors which it may discover in the DBA Documents (including those Reference Information Documents that are referenced in the DBA Documents, and pursuant to Section 1.2.3 above, are considered DBA Documents), and shall obtain specific instructions in writing from TxDOT regarding any such Error before proceeding with the Work affected thereby.

  • This Section 1.11 applies to all monetary obligations of TxDOT set forth in the DBA Documents, notwithstanding any contrary provisions of the DBA Documents.

  • Should it appear that the Work to be done or any matter relative thereto is not sufficiently detailed or explained in the DBA Documents, DB Contractor shall request in writing such further written explanations from TxDOT as may be necessary and shall comply with the explanation provided.

  • In connection with DB Contractor’s obligations under the DBA Documents, including repair of damage to the Project caused by collision (motor vehicle, aircraft or railroad train), vandalism, or other acts of destruction or damage by third parties, DB Contractor shall have the right, in its reasonable discretion, to lawfully pursue claims against third parties for damage caused to the Project.

  • DB Contractor shall not take advantage of or benefit from any apparent Error in the DBA Documents.

  • No such limits of liability or approved variances therefrom shall preclude TxDOT from taking any actions as are available to it under the DBA Documents or otherwise at Law.

  • All TxDOT monetary obligations under the DBA Documents are subject to appropriation by the Texas Legislature.

  • The fact that the DBA Documents omit or misdescribe any details of any Work which are necessary to carry out the intent of the DBA Documents, or which are customarily performed, shall not relieve DB Contractor from performing such omitted Work (no matter how extensive) or misdescribed details of the Work, and they shall be performed as if fully and correctly set forth and described in the DBA Documents, without entitlement to a Change Order hereunder except as specifically allowed under Section 13.

  • The DBA Documents do not create a debt under the Texas Constitution.

  • Exhibit 1 hereto contains the meaning of various terms used in the DBA Documents.

Related to DBA Documents

  • Financing Documents means collectively the documents evidencing Lenders’ commitment to finance the Project.

  • Bid Documents means all the documents issued by the Chief Procurement Officer, or referenced by the Chief Procurement Officer as being available on the City's website and incorporated by such reference, in connection with an invitation for bids or proposals. Except for such Bid Documents as are posted on the City's website and incorporated by reference, all Bid Documents must be submitted by a bidder on the Bid Opening Date.

  • Related Documents mean all promissory notes, credit agreements, loan agreements, environmental agreements, guaranties, security agreements, mortgages, deeds of trust, security deeds, collateral mortgages, and all other instruments, agreements and documents, whether now or hereafter existing, executed in connection with the Loan.

  • LC Documents means all applications, agreements and instruments relating to the Letters of Credit but excluding the Letters of Credit.

  • Documents includes any and all instruments, documents, agreements, certificates, indentures, notices and other writings, however evidenced.

  • Credit Documents mean the agreements, instruments, certificates or other documents at any time evidencing or otherwise relating to, governing or executed in connection with or as security for, a Loan, including without limitation notes, bonds, loan agreements, letter of credit applications, lease financing contracts, banker's acceptances, drafts, interest protection agreements, currency exchange agreements, repurchase agreements, reverse repurchase agreements, guarantees, deeds of trust, mortgages, assignments, security agreements, pledges, subordination or priority agreements, lien priority agreements, undertakings, security instruments, certificates, documents, legal opinions, participation agreements and intercreditor agreements, and all amendments, modifications, renewals, extensions, rearrangements, and substitutions with respect to any of the foregoing.

  • Underlying Documents means, together, the Contracts, the Refund Guarantees, the Supervision Agreements and the Management Agreements and "Underlying Document" means any of them.

  • Facility Documents means this Agreement, the Notes, the Account Control Agreement, the Sale Agreement, the Administrative Agent Fee Letter, the Lender Fee Letter, the Collateral Administration and Agency Fee Letter and any other security agreements and other instruments entered into or delivered by or on behalf of the Borrower in favor of the Collateral Agent, the Administrative Agent or any Lender from time to time pursuant to this Agreement.

  • Bidding Documents means the set of Bidding Documents that preceded the placement of the Contract of which these GCC form a part, which were sold or issued by the Purchaser to potential Bidders, and in which the specifications, terms and conditions of the proposed procurement were prescribed.

  • Loan Documents means, collectively, this Agreement, any note or notes executed by Borrower, and any other document, instrument or agreement entered into in connection with this Agreement, all as amended or extended from time to time.
