Common use of Xxxxxxx and Employee Involvement Clause in Contracts

Xxxxxxx and Employee Involvement. (a) In all cases involving a grievance, all employees except the grievor(s) must continue to work. Where an employee or employees has or have been discharged by the Employer, he or they shall not remain in the employ of the Employer while his or their grievance is being processed in accordance with this grievance procedure. (b) An employee who has lodged a grievance may elect not to continue working while the grievance is being processed, without loss of seniority or benefit entitlement. (This provision has no application in cases involving the suspension or discharge of the employee, or where the subject of the grievance is the Employer’s denial of a request for a discretionary leave of absence.) A grieving employee who elects not to work while the grievance is being processed shall not be entitled to claim any compensation for the period in which he has elected not to work. (c) The Union agrees that the processing of any grievance shall be carried out by all parties with the minimum possible interruption to the Company’s operations.
