Xxxxxxx Clause. Section 1. The Business Manager may appoint a xxxxxxx for a crew on all projects or portions of project, whose duty it will be to see to it that this contract is adhered to and that all work coming under the jurisdiction of the Union is performed by employees covered by this Agreement. This will not be interpreted to require contractors to transfer a xxxxxxx with a crew or any portion of a crew from the jurisdiction of Local 751. Section 2. The xxxxxxx is to perform all duties assigned to him by the Business Manager. The xxxxxxx is to work the same as any other employee on the job. Section 3. It shall be the duty of the xxxxxxx to report to the Union any accident to any of the men which may occur on the job where employed. If the employee's occupational injury permits him to continue to work, but requires subsequent visits or necessary medical treatment during his scheduled work hours, he will be paid for the time lost from his scheduled work in making such visits. Section 4. The xxxxxxx shall not be transferred from one project to another without getting consent from the Business Manager. Section 5. The Employer shall recognize the right of the Union to select a xxxxxxx from among its employees to perform the duties assigned to the xxxxxxx by the Union. Section 6. The xxxxxxx shall not be discharged because he is performing his duties as a xxxxxxx, nor shall the xxxxxxx be discriminated against because of his affiliation with the Union or because of his activities on behalf of the Union. Section 7. The xxxxxxx shall work when there is any work to be performed by the laborers. He shall be the last man on the job if qualified. No xxxxxxx shall be discharged without the Employer conferring with the Business Manager of the Local Union involved, and a mutual understanding arrived at. The xxxxxxx shall be allowed a reasonable amount of time to police the job when necessary. Section 8. When an Employer sees fit to discharge an employee or employees or have a reduction in the work force, he is to notify the xxxxxxx before taking such action. Section 9. When a job is temporarily shut down due to weather, material shortages or similar cause, and employees are laid off, the xxxxxxx shall be the first employee recalled to work when the work resumes, if qualified.

If the Employer deems it desirable, all laborers, maintenance and repair work on mechanical work on equipment done on the job site may be done by the local Union having jurisdiction over the operation of that equipment. 2. Wages, shall be paid by direct deposit, collectable check or pay card to workers weekly at the end of the shift not later than three (3) workdays after the pay period, unless approval of pay rolls by governmental agencies prevent such payment at that time. Failure on the part of the Employer to comply with this provision shall entitle the employee to $250.00 damages, provided the delay is occasioned by the willful refusal of the Employer or his agent. Employees shall provide their bank account information to their employer if qualifiedthey wish to be paid by direct deposit. Otherwise, the employer shall issue a collectable check or paycard to each employee, at no cost to the employee, and all pay shall be credited to the collectable check or pay card. Employees who lose their pay card will be responsible for the cost of the replacement. 3. Any Employer who fails to have sufficient funds in the bank to meet all pay checks issued to employees shall be liable also for the cost of collecting the amount due and the defaulting Employer is to be deprived of the right to pay by check. 4. Check stubs will show straight-time and overtime hours worked plus total wages and all itemized deductions. 5. If a worker quits of his own accord, he shall wait for his pay until the next regular pay day. 6. An employee who is discharged or laid off shall be paid in full without undue delay or the penalty provision of paragraph 2 of this article will apply. 7. When a holiday falls on Friday and Friday is the regular pay day, the laborers shall be paid on Thursday evening on or before quitting time if there is no work for them on Friday.
