Rights and obligations of the Provider. 6.1. The Provider is obliged to treat the Service Recipient on business days during the opening hours of the individual Medical Facilities, save for exception under the provision 2.5 of these BTC. In the case of change in the opening hours, the Client shall be informed through the Provider’s client line and/or through the Provider’s webpage.
Rights and obligations of the Provider. 6.1. The Provider is obliged to treat the Service Recipient on business days during the opening hours of the individual Medical Facilities, save for exception under the provision 2.5 of these BTC. In the case of change in the opening hours, the Client shall be informed through the Provider’s client line and/or through the Provider’s webpage. 6.2. With respect to the fact that the Provider provides the Services at a precisely determined time, for which the Services Recipients are ordered to the Provider and which time is exclusively intended for provision of the Services to the given Service Recipient, the Provider suffers a damage (i.e. a financial damage) in the case that the Service Recipient fails to use the provided time without any excuse. Therefore, the Client expressly acknowledges and is obliged, in order to eliminate any such damage, to secure that in the case that the agreed appointment should be cancelled or not realized by the Service Recipient, the Service Recipient notifies of cancellation of the agreed appointment at least 1 business day (at least 24 hours) prior to the agreed time of appointment. If the Service Recipient fails to do so, the Provider automatically becomes entitled to a one-time contractual penalty in the amount of CZK 300 (in words: three hundred Czech crowns). The Provider is entitled not to demand this penalty at its own discretion. The contractual penalty shall be due within 14 days from the day when the written notice demanding the payment of the contractual penalty is delivered to the Client. The Client is obliged to pay the contractual penalty in accordance with the payment terms stated in the notice demanding to pay the contractual penalty. 6.3. The Provider is entitled to suspend the provision of the Services in the case that the Client fails to pay its due obligations towards the Provider even within the additional period given by the Provider in the written notice demanding to pay such outstanding due obligations. 7.
Rights and obligations of the Provider. 5.1. The Provider undertakes to transfer to the User the Power Bank for temporary use and allow the User to use the Service. The Provider undertakes to provide the Service to suit its intended purpose, i.e. that the Service enables the User to use the portable Power Bank for the purposes of charging a portable mobiledevice.

  • Final provisions 10.1. The legal relationship between the Provider and the Client is governed by the legal regulations of the Czech Republic, the Agreement and these BTC. In accordance with the relevant provisions of the Civil Procedure Code, the Provider and the Client have agreed that the Municipal Court in Prague shall have the jurisdiction, if the territorial jurisdiction in the first instance proceeding is given to regional court, and that the District Court for Prague 6 shall have the jurisdiction, if the territorial jurisdiction in the first instance proceeding is given to district courts. 10.2. The Provider is entitled to change unilaterally the BTC. The Provider shall notify the Client in writing of any change in the BTC at least month one prior to the expected change to the BTC coming into effect, by sending and informative e-mail to the Client’s e-mail address stated in the header of the Agreement, whereas within the framework of the above-mentioned time specification, it must be made possible for the Client to familiarise himself/herself comprehensively with the content of such change to the BTC or by publishing the information on change of the BTC at the Provider’s webpage xxx.xxxxxxxx.xx. Such effectiveness of change to the BTC may occur at the earliest after expiry of the period which is mentioned in the previous sentence. The Client is entitled to reject any change of BTC in writing. If the Client rejects the proposed change to the Business Terms and Conditions (BTC) in writing, the Client and the Provider shall be entitled to give written notice of termination of the Contract, no later than the date on which the new BTC (or altered BTC) come into effect. 10.3. Appendix No. 1 constitutes an integral part of these BTC. 10.4. These BTC become effective as of 1.5.2024 and replace BTC_IND_NPP_240301.
