Warranty claims. Wa rranty claims issued by the customer aretobe reported tothe contractor immediately after the r discovery and should be made in writing. When submitting warranty daims, the parts relating to these are to be sent to the contractor ca rriage free, otherwise the freight costs will be subsequently charged to the customer. The contractor performs his warranty obligations at his own discretion either by repai r ng all the parts that have developed a fau lt during the warranty period as a result of a mate r al defect or incorrect workmanship, or by replacing these with new parts. This warranty does not indude defects that ar se as a resu lt of improper use, failure to observe the serviceintervals or failure to observe the manufacturer's operating instructions. No warranty provision whatsoever applies for wear parts (oils, lubricants, drive belts, seals).
Warranty claims. 10.1 If the Purchaser wishes to claim that any Seller's Warranty has been breached and that the Purchaser's Compensation is payable under clause 9 and/or if the Purchaser learns of a circumstance that could constitute a Warranty Breach in respect of the Seller's Warranties (the "Warranty Claim"), the Purchaser has to do so in accordance with the following procedure described in this clause 10.
Warranty claims. 1. STM Participant can make a warranty claim with OKTE, a.s., in regard of technical problems while receiving orders and providing the short-term market results. The trading area price and the quantity allocated to orders in the daily market matching process shall be covered by a warranty claim.
