Place of Performance and Jurisdiction. For both Parties, the place of Performance and venue shall be Burgwedel located in the Federal Republic of Germany.

10.2 If the customer is a merchant, our place of business shall be the place of jurisdiction; however, we shall also be entitled to sue the customer at the court of his place of business.
10.3 The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
10.4 Should a provision in these General Terms and Conditions or a provision within the framework of other agreements between the customer and us be or become invalid, this shall not affect the validity of all other provisions or agreements. In this case, the invalid provision shall be replaced by a provision that comes as close as possible to the economic intention of the parties at the time the contract was concluded.
Place of Performance and Jurisdiction. 11.1 Place of performance regarding deliveries shall be Schweinfurt. If delivery is carried out from one of our plants, the place of performance regarding deliveries shall be the location of such plant. Place of performance regard- ing payments shall be Schweinfurt.
11.2 Place of jurisdiction regarding any legal disputes arising from the contract shall be Schweinfurt. We shall be also entitled to take legal action at the buyer’s place of business.
11.3 All legal relations between the buyer and us shall be gov- erned by the law of the Federal Republic of Germany to the exclusion of the United Nations’ Convention of 11 April 1980 on Contracts for the International Sale of Goods.
Place of Performance and Jurisdiction. 14.1 The place of performance for all contracts concluded with seller shall be Xxxxxxxxxx.
14.2 All disputes arising from or in connection with contracts between purchaser and seller, including disputes concerning the question of the valid conclusion and the preliminary and retroactive effects of such contracts, shall be subject to the jurisdiction of the court in Zell am See that is materially competent for such cases.
Place of Performance and Jurisdiction. If the participant at ACT Camp 2023 is a merchant within the meaning of the Commercial Code, a legal entity under public law, or a public-law special fund, the place of jurisdiction for all rights and obligations of the contractual parties is Kürten. However, ACT is also entitled to sue the contractual partner at their general place of jurisdiction.

Our business premises will be the place of performance for both parties if you are a businessman or a legal person in public law or a special public fund or your residence is located outside the Republic of Austria. The applicable law at the place of performance will be authoritative for the legal relationships between you if you are a businessman and us, including if the legal dispute is conducted abroad. If you are a businessman or a legal person in public law or a special public fund, we may institute legal proceedings at the jurisdiction of the place of performance; legal procee- dings may only be instituted at this jurisdiction.
Place of Performance and Jurisdiction. The place of performance and jurisdiction shall be Münchenstein / Reiden / Muttenz. For all disputes between the parties Swiss material law shall be applica- ble. International agreements shall be excluded.
