Acid Gas Flaring Device or “AG Flaring Device” shall mean any device that is used for the purpose of combusting Acid Gas and/or Sour Water Stripper Gas, except facilities in which gases are combusted to produce sulfur or sulfuric acid. The AG Flaring Devices currently in service are identified in Paragraph 32. To the extent that, during the duration of the Consent Decree, a Refinery uses AG Flaring Devices other than those specified in Paragraph 32 for the purpose of combusting Acid Gas and/or Sour Water Stripper Gas, those AG Flaring Devices shall be covered under this Consent Decree.
Acid Gas Flaring Device or “AG Flaring Device” shall mean the devices identified in Appendix F that are used at the Covered Refineries to combust Acid Gas and/or Sour Water Stripper Gas. The term “Acid Gas Flaring Device” does not include facilities in which gases are combusted to produce sulfur or sulfuric acid. To the extent that, during the duration of the Consent Decree, any Covered Refinery utilizes any Flaring Devices other than those specified above for the purpose of combusting Acid Gas and/or Sour Water Stripper Gas, those Flaring Devices shall be AG Flaring Devices and shall be subject to the requirements of this Consent Decree.

To the extent that, during the duration of the Consent Decree, the Covered Refineries utilize AG Flaring Devices other than those specified in this Consent Decree for the purpose of combusting Acid Gas and/or Sour Water Stripper Gas, those AG Flaring Devices shall be covered under this Consent Decree.

The AG Flaring Devices currently in service at Eagle Point Refinery are identified in Appendix A to the Consent Decree. To the extent that, during the duration of the Consent Decree, the Eagle Point Refinery utilizes AG Flaring Devices other than those specified in

Acid Gas Flaring Device or “AG Flaring Device” shall mean any device used to combust Acid Gas and/or Sour Water Stripper Gas, except facilities in which gases are combusted to produce sulfur or sulfuric acid. The Acid Gas Flaring Devices currently in service at the El Paso Refinery are the Relief Gas Emergency Flare (EPN D-2914); the Rheniformer Emergency Flare (EPN R-2911); and the Plant Emergency/AAG/Main South Flare (EPN 112).
