Actual Capital Expenditure Amount definition

Actual Capital Expenditure Amount means the aggregate amount of Capital Expenditures of the Company and the Subsidiaries, on a consolidated basis, from January 1, 2017 through the Designated Date for work performed on or after January 1, 2017, calculated in accordance with Section 1.2(a)(xiv) and the Agreed Principles (it being understood that the Actual Capital Expenditure Amount shall not include any Capital Expenditures made prior to January 1, 2017 (even if paid on or after January 1, 2017)).
Actual Capital Expenditure Amount has the meaning set forth in Section 2.3(b).
Actual Capital Expenditure Amount means the amount of any capital expenditures made by Seller between January 1, 2006 and the Effective Time, that increase the Rate Base Assets or CWIP, as finally determined pursuant to Section 3.3.

Examples of Actual Capital Expenditure Amount in a sentence

  • If such Actual Capital Expenditure Amount, as finally determined pursuant to this Section 2.3(b), increases the Shortfall Amount from the amount determined using the Estimated Capital Expenditure Amount, ETP shall, within 10 Business Days following such final determination, make a cash payment in immediately available funds to ETIH equal to the amount by which the Shortfall Amount so increased.

  • If OGE disagrees with the Estimated Capital Expenditure Amount, OGE may, within 30 days after Closing, deliver a notice to ETP disagreeing with the Estimated Capital Expenditure Amount and setting forth OGE’s calculation of the Actual Capital Expenditure Amount (a “Notice of Disagreement”).

  • If a Notice of Disagreement shall be duly delivered pursuant to the immediately preceding sentence, ETP and OGE shall, during the 30 days following such delivery, use reasonable efforts to reach agreement on the disputed items or amounts in order to determine the Actual Capital Expenditure Amount.

  • If the Actual Capital Expenditure Amount is less than the Budgeted Capital Expenditure Amount then the Closing Date Cash Consideration shall be decreased by an amount equal to twenty-five percent (25%) of such deficit.

Actual Capital Expenditure Amount means the aggregate amount of capital expenditures directly related to the Eagle Ford Business made by the Parent Parties and Newco during the period beginning on January 1, 2011 and ending on June 30, 2011.

Related to Actual Capital Expenditure Amount

  • Annual Capital Expenditure Adjustment means, for any retail Property, an amount equal to the product of (a) $0.15 multiplied by (b) the aggregate net rentable area (determined on a square feet basis) of all such Properties.

  • Consolidated Capital Expenditures means, for any period, the aggregate of all expenditures of Company and its Subsidiaries during such period determined on a consolidated basis that, in accordance with GAAP, are or should be included in “purchase of property and equipment or similar items”, or that should otherwise be capitalized, as reflected in the consolidated statement of cash flows of Company and its Subsidiaries.
