Affected Facilities definition

Affected Facilities means the sources of fugitive emissions listed in section 1(a) of this rule.

Affected Facilities has the meaning set forth in Section 6.03(c).

Affected Facilities means those Financing Documents in respect of which (and in the Borrower’s opinion) Waivers and/or Amendments are required for the entry into and the performance by the Borrower of the transactions contemplated by the Finance Documents and the Strategic Plan;

Affected Facilities has the meaning set forth in Section 4.4 hereof.

Affected Facilities means any Debt of the Company or any of its Restricted Subsidiaries existing on the date of this Indenture other than Debt incurred through the issuance of bonds or notes in the capital markets and outstanding on such date, in each case, as amended, restated, refunded, renewed, replaced or refinanced (including increasing the amount borrowed thereunder) in whole or in part from time to time.

Affected Facilities means the Financial Commitments existing as at the Signing Date in relation to which consents/ amendments/ waivers/ extensions are necessary in the opinion of the Borrower to enter into the Facility and the Strategic Plan and to fulfil the obligations provided thereunder, as the same are listed in schedule V hereto.

Affected Facilities means the sources of fugitive emissions listed in subsection (a).

Affected Facilities means the Facility under this Agreement and the other financing arrangements in respect of which (and in the Borrower’s opinion) waivers and/or amendments are required for the entry into and the performance by the Borrower of the transactions contemplated by the Bridge Facility Agreement, the Extended Facility Agreements and the Strategic Plan, being the facilities identified in Schedule 13;

Affected Facilities means the credit facilities in relation to which any Waiver or Amendment is required and which is identified in Schedule 13 (Affected Facilities).

Affected Facilities have the respective meanings given to such terms in the recitals to the Agreement to which this Appendix A is attached.
