Amended Declaration definition

Amended Declaration means the Amended and Restated Declaration of Trust of the Issuer Trust referred to in the recitals to this Guarantee Agreement, as modified, amended or supplemented from time to time.

Amended Declaration means this Amended and Restated Declaration of Trust, as the same may be modified, amended or supplemented in accordance with the applicable provisions hereof, including (i) all exhibits, and (ii) for all purposes of this Amended Declaration and any such modification, amendment or supplement, the provisions of the Trust Indenture Act that are deemed to be a part of and govern this Amended Declaration and any such modification, amendment or supplement, respectively.

Amended Declaration means the Amended and Restated Declaration of Trust, dated as of October 30, 2007, among the Company, as sponsor, Wilmington Trust Company, as the Property Trustee and the Delaware Trustee, and the Administrative Trustees.

Examples of Amended Declaration in a sentence

• The provisions of Article VI of the Amended Declaration concerning meetings of the Holders shall apply to the giving of such approval.

• This Amended Declaration shall be binding upon and shall inure to the benefit of any successor to the Sponsor, the Issuer Trust and any Issuer Trustee, including any successor by operation of law.

Nothing in this Amended Declaration shall be construed to release an Administrative Trustee from liability for his or her own negligent action, his or her own negligent failure to act, or his or her own willful misconduct.

• Any reference in this Amended Declaration to the Paying Agent shall include any co-paying agent unless the context requires otherwise.

Amended Declaration means and refer to each and every instrument recorded in the Records which amends, supplements, modifies, clarifies or restates some or all of the terms and provisions of this Declaration.
