Within 15 days after entry of the Preliminary Approval Order, Class Counsel will review Defendant’s Revised Disclosures and will provide, in good faith, additional proposed revisions relating to APSN Fees and Retry Fees that Class Counsel approves of.
A Class Member whose Uncollected Amounts are less than the total APSN Fees and Retry Fees on his or her account may receive both forgiveness of Uncollected Amounts under this section and a distribution of Settlement Class Member Payments.

The total APSN Fees and total Retry Fees assessed to the Account of each Participating Class Member, added together, shall be referred to as the total “Eligible Fees” for that Account.
