Arbitrator List definition

Arbitrator List. As defined in Section 1.9(c).
Arbitrator List has the meaning given such term in Section 9.10(c).

  • The Parties may modify the Arbitrator List by mutual agreement in writing from time to time.

  • If such highest-ranked arbitrator from the Arbitrator List is not available to conduct the arbitration or is not then disinterested, then the next-highest ranked arbitrator that is then available and then disinterested shall be selected.

  • An individual shall remain on the Arbitrator List until removed by the consent of all the Parties hereto; provided that if any individual on the Arbitrator List dies, refuses to serve or for any other reason is unable to serve, the Parties shall mutually designate an additional individual to fill the vacancy on the Arbitrator List thereby created.

  • If there are no Arbitrators designated on the Arbitrator List as such time, the Arbitrator shall be determined by the Selection Process or, if the Selection Process is unsuccessful, by the AAA Process.

Related to Arbitrator List

  • Arbitrator means the authority nominated by Chief General Manager (CGM) for arbitration.

  • Notice of Arbitration means the formal notice from the CONTRACTOR or the CUSTOMER to the other party referring a dispute to arbitration in accordance with the provisions of Schedule 2-9.

  • Referee means a person who is designated as a referee under the friend of the court act.

  • Mediation means any process in which a mediator facilitates communication and negotiation between the parties to assist them in reaching a voluntary agreement regarding their dispute.

  • Expedited Appeal means if a Member appeals a decision regarding a denied request for Prior Authorization (Pre-Service Claim) for an Urgent Care Claim, the Member or Member’s Authorized Representative can request an Expedited Appeal, either orally or in writing. Decisions regarding an Expedited Appeal are generally made within seventy-two (72) hours from the Plan’s receipt of the request.

  • JAMS means JAMS, Inc. or its successor entity, a judicial arbitration and mediation service.

  • Arbiter has the meaning set forth in Section 1.05(d).

  • Neutral ’ means an individual who, with respect to an issue in controversy, functions specifically to aid the parties in resolving the controversy;

  • ICC Rules means the Rules of Arbitration of the International Chamber of Commerce in effect on the date the applicable arbitration proceeding begins.

  • Appeal Tribunal means the all-citizen Tribunal duly appointed by Council to conduct hearings under this By-law; (200-08)

  • Accounting Arbitrator has the meaning set forth in Section 2.6(c).

  • Arbitral Tribunal means a sole arbitrator or a panel of arbitrators;

  • Arbitrable Dispute means any dispute arising under or in connection with this Agreement.

  • Appeals Tribunal or “AT” means the Body responsible for hearing and determining appeals set out in section 9;

  • Arbitration Notice has the meaning set forth in Section 9.13.

  • Hearing Panel means a panel responsible for adjudicating disciplinary cases pursuant to a Notice of Charges authorized by a Review Panel.

  • AAA Rules has the meaning set forth in Section 11.2.

  • AAA means the American Arbitration Association.

  • Dispute Resolution Process means the process described in clause 9
