Lack of a sufficient appropriation shall be evidenced by the passage of an ordinance or resolution by the governing body of Lessee specifically prohibiting Lessee from performing its obligations under such Lease and from using any moneys to pay the Rental Payments due under such Lease for a designated Budget Year and all subsequent Budget Years.
Whenever any Event of Default exists with respect to a Lease, Lessor shall have the right to take one or any combination of the following remedial steps: (a) With or without terminating the Lease, Lessor may declare all Rental Payments and other amounts payable by Lessee thereunder to the end of the then current Budget Year so be immediately due and payable.
If insufficient funds are available in Lessee’s budget for the next Budget Year to make the Rental Payments for the next Renewal Term with respect to any Lease, then Lessee shall have the option to terminate such Lease at the end of the current Budget Year.
The Districts agree that administration services for each of the Districts can be most effectively and efficiently provided through the CAB, and the Districts acknowledge that, in planning and budgeting for each Budget Year, the CAB will need to make decisions concerning the anticipated costs of the provision of Operations and Maintenance Services, including the costs of providing administration services for the CAB and for each of the Districts.
