COD Network Upgrades definition
COD Network Upgrades means upgrades to the Pool Transmission Facilities and the Transmission Provider’s transmission and distribution systems, as determined and identified in the interconnection study approved in connection with construction of the Facility, necessary for Delivery of the Energy to the Delivery Point; provided, however, that in no event shall COD Network Upgrades include the additional upgrades necessary to achieve the summer Seasonal Claimed Capability and winter Seasonal Claimed Capability described in Section 3.7(a) of this Agreement.
