Where the term of the lease or licence is to be less than five years, and Section 20B of the Retail and Commercial Leases Act 1995 applies, the Lessee or Licencee shall be required to provide Council with a certified exclusionary certificate duly signed by the Lessee’s or Licensee’s solicitor waiving the minimum statutory term of five years in the form required by the Act.
