Competing applicants means two or more persons or health care facilities as defined in this article who apply for Certificates of Need to provide similar services or facilities in the same service area within a time frame as established by departmental regulations and whose applications, if approved, would exceed the need for services or facilities.

Competing applicants means two or more persons and/or health care facilities as defined in this regulation Section 44-7-130 of the South Carolina Code of Laws who apply for Certificates of Need to provide similar services and/or facilities in the same service area within the time frame established in this section and whose applications, if approved, would exceed the need for this facility or service the services or facilities. An application shall be considered competing if it is received by the Department no later than fifteen thirty (1530) calendar days after a Notice of Affected Persons is published in the State Register notice is posted on the Department’s website, pursuant to Section 202 of this Regulation, that an application has been accepted for filing for one or more applications for similar services and/or facilities in the same service area. All Only applications received by the Department within fifteen thirty (1530) calendar days of publication of the Notice of Affected Persons in the State Register for the posting on the Department’s website that the first application(s) has been accepted for filing will be considered to be competing. Any applications received by the Department later than the fifteenth day following publication of the Notice of Affected Persons in the State Register for the first application(s) will not be considered to be competing with the(se) application(s).
