Concessionaire Change definition

Concessionaire Change means a change proposed by the Concessionaire by submitting a notice to HPTE.
Concessionaire Change has the meaning set out in Clause 37;
Concessionaire Change means a Change that is initiated by the Concessionaire by submitting a Concessionaire Change Notice to HPTE;

Examples of Concessionaire Change in a sentence

  • For the avoidance of doubt the Concessionaire shall not amend or change the Concessionaire's Proposals except by way of a Concessionaire Change.

  • Where the Concessionaire Change is necessary for the Concessionaire to comply with Section 14.3, HPTE shall not be entitled to unreasonably withhold its consent to such a Concessionaire Change provided the implementation, rectification and consequential impact, is at the Concessionaire's expense.

  • A Concessionaire Change pursuant to this Section 11.4.1 will not, unless it is consented to by the Province’s Representative as provided in Section 11.4.3, in any way qualify or relieve the Concessionaire of its primary responsibility to comply with, satisfy and perform the Construction Output Specifications notwithstanding any review of or failure to object to the proposed Concessionaire Change by the Province's Representative.

  • The Concessionaire will not proceed to implement a proposed Concessionaire Change unless and until there has been no objection in accordance with the Review Procedure (on the grounds set out in paragraph 3.2 of Part 2 of Schedule 8 [Review Procedure]) and the relevant Concessionaire Change Certificate has been issued by the Concessionaire’s Representative and duly countersigned by the Province's Representative in accordance with paragraph 7 of Part 2 of Schedule 8 [Review Procedure].

  • For greater certainty, except to the extent provided in Part 3 of Schedule 13 [Concessionaire Changes] or in paragraph (r) of the definition of "Compensation Event" in Section 1 of Schedule 1 [Definitions and Interpretation], no additional payment to the Concessionaire or adjustment to the Total Performance Payment will be made as a consequence of implementation of a Concessionaire Change.

  • For greater certainty, except to the extent provided in Part 3 of Schedule 13 [Concessionaire Changes], no additional payment to the Concessionaire or adjustment to the Performance Payment will be made as a consequence of implementation of a Concessionaire Change.

  • The Concessionaire will not proceed to implement a proposed Concessionaire Change unless and until there has been no objection in accordance with the Review Procedure (on the grounds set out in paragraph 3.2 of Part 2 of Schedule 8 [Review Procedure]) and the relevant Concessionaire Change Certificate has been issued by the Concessionaire’s Representative and duly countersigned by the Province’s Representative in accordance with paragraph 7 of Part 2 of Schedule 8 [Review Procedure].

  • A Concessionaire Change pursuant to this Section 11.4.1 will not in any way qualify or relieve the Concessionaire of its primary responsibility to comply with and satisfy the Construction Output Specifications notwithstanding any review of or failure to object to the proposed Concessionaire Change by the Province’s Representative.

  • All costs arising out of any Concessionaire Change of Scope requested by Concessionaire under this Clause 16.1.2 during the Construction Period shall be borne by the Concessionaire.

  • In case the Authority does not respond to the Concessionaire’s proposal for Concessionaire Change of Scope within thirty (30) days from the date of receipt of the proposal, it shall be deemed that the change of scope of work have not been accepted by the Authority.


More Definitions of Concessionaire Change

Concessionaire Change means a variation in the design, quality or scope of the Works or any provision relating to the Decommissioning initiated by the Concessionaire in accordance with Section 11.4 [Concessionaire Changes] and, subject to Section 11.4.3, may include additions, deletions, substitutions, alterations in design and/or variations in or to the Construction Output Specifications and/or the Construction Requirements; and, for purposes of Section 11.4.3 and Part 3 of Schedule 13 [Concessionaire Changes], “Concessionaire Change” will be deemed to include an Alternative Concept.
Concessionaire Change means a change proposed by the Concessionaire in accordance with Schedule 21.

Related to Concessionaire Change

  • Concessionaire shall have the meaning attributed thereto in the array of Parties hereinabove as set forth in the Recitals;

  • Collocation is an arrangement where CenturyLink provides space in CenturyLink Premises for the placement of CLEC's equipment to be used for the purpose of Interconnection or access to CenturyLink Unbundled Network Elements. "Collocation – Point of Interconnection" or "C-POI" is the point outside CenturyLink's Wire Center where CLEC's fiber facility meets CenturyLink's Fiber Entrance Facility, except where CLEC uses an Express Fiber Entrance Facility. In either case, CenturyLink will extend or run the Fiber Entrance Facility to CLEC's Collocation Space. "Commercial Mobile Radio Service" or "CMRS" is defined in 47 U.S.C. § 332 and FCC rules and orders interpreting that statute.

  • Supplier Operations means all assets, processes and systems (including information systems), data (including Customer data), personnel, and sites, used or processed by Supplier from time to time in the performance of this Agreement.

  • Licensed Space means the indoor and outdoor space on the premises approved by the department for the purpose of providing licensed child care.

  • Telecommunications facilities means apparatus necessary or useful in the production, distribution,

  • occupier in relation to a property, shall mean a person in actual occupation of the property, whether or not that person has a right to occupy the property.

  • Premises means the location where the Services are to be supplied, as set out in the Specification.

  • Casino means a casino as defined in section 1 of the KwaZulu-Natal Gaming and Betting Act, 2010 (Act No. 8 of 2010);

  • Space means the volume of gas which a user of a storage facility is entitled to use for the storage of gas;

  • Restaurant means a business location:

  • Protected Space Operations means all Launch or Transfer Vehicle activities, ISS activities, and Payload activities on Earth, in outer space, or in transit between Earth and outer space in implementation of the IGA, MOUs concluded pursuant to the IGA, implementing arrangements, and contracts to perform work in support of NASA's obligations under these Agreements. It includes, but is not limited to:

  • Expansion to an existing manufactured home park or subdivision means the preparation of additional sites by the construction of facilities for servicing the lots on which the manufactured homes are to be affixed (including the installation of utilities, the construction of streets, and either final site grading or the pouring of concrete pads).

  • Telecommunications Business means the business of (i) transmitting, or providing services relating to the transmission of, voice, video or data through owned or leased transmission facilities, (ii) creating, developing or marketing communications related network equipment, software and other devices for use in a Telecommunications Business or (iii) evaluating, participating or pursuing any other activity or opportunity that is primarily related to those identified in (i) or (ii) above; provided that the determination of what constitutes a Telecommunications Business shall be made in good faith by the Board of Directors of the Guarantor.

  • Licensed premises or “premises” means all rooms, enclosures, contiguous areas, or places susceptible of precise description satisfactory to the administrator where alcoholic beverages, wine, or beer is sold or consumed under authority of a liquor control license, wine permit, or beer permit. A single licensed premises may consist of multiple rooms, enclosures, areas, or places if they are wholly within the confines of a single building or contiguous grounds.

  • Airport means public-use airport open to the public without prior permission and without restrictions within the physical capacities of available facilities.

  • Common Areas and Facilities means collectively the Development Common Areas and Facilities and the Residential Common Areas and Facilities and all those parts and such of the facilities of the Development designated as common areas and facilities in any Sub-Deed;

  • Service Areas means those areas within the Building used for stairs, elevator shafts, flues, vents, stacks, pipe shafts and other vertical penetrations (but shall not include any such areas for the exclusive use of a particular tenant).

  • Service Area means the geographic area approved by the commissioner within which an issuer is authorized to offer a Medicare Select policy.

  • Market Operations Center means the equipment, facilities and personnel used by or on behalf of a Market Participant to communicate and coordinate with the Office of the Interconnection in connection with transactions in the PJM Interchange Energy Market or the operation of the PJM Region.

  • Telecommunications Facility means the machine, equipment, transmission path or other electrical facilities for telecommunication.

  • Business Centre means each of the places so specified in the relevant Pricing Supplement.

  • Planned development means a real property development other than a community apartment project, a condominium project, or a stock cooperative, having either or both of the following features:

  • Airport Facilities means any of the following at an airport:

  • New Building ’ means a new construction to house a complete motor vehicle as- sembly process, where that construction includes the pouring or construction of a new foundation and floor, the erection of a new frame and roof, and the instal- lation of new plumbing and electrical and other utilities;

  • Radiographic operations means all activities performed with a radiographic exposure device, or with a radiation machine. Activities include using, transporting except by common or contract carriers, or storing at a temporary job site, performing surveys to confirm the adequacy of boundaries, setting up equipment, and any activity inside restricted area boundaries. Transporting a radiation machine is not considered a radiographic operation.

  • Communications Equipment means the communications equipment of the Licensee and its affiliates, including, without limitation, cabinets, racks, electronic equipment and other similar equipment.
