Confirmed Order definition

Confirmed Order means an order or other indication of interest, in accordance with industry standards, by a customer not an Affiliate of the Parent Guarantors, the Borrowers or any of their Subsidiaries which has been accepted in the ordinary course of business by representatives of any Parent Guarantor, any Borrower or any of their Subsidiaries.
Confirmed Order means an order by a customer (other than an Affiliate of the Borrower) that has been accepted in the ordinary course of business by representatives of the Borrower or an Affiliate of the Borrower and recorded on the inventory records of such Affiliate or the Borrower.
Confirmed Order means an Order as accepted by a Confirmation of Order in accordance with clause 2.1 (and in the event of any discrepancy between the Order and the Confirmation of Order, the information contained in the Confirmation of Order will prevail in accordance with clause 2.2).

Examples of Confirmed Order in a sentence

  • Each Confirmed Order shall specify the quantity, Delivery date(s), the Price, or Price referenced to a Market Value, and any such other information as the Parties may agree to include.

  • This may include an event that could result in an unscheduled Facility shutdown, or the possible event that one or more Product orders are not available from Producer in the quantity originally set out in the Confirmed Order.

  • The remedy specified in this Section 4.3 shall be Gavilon’s sole and exclusive remedy in the event that Producer fails to supply the quantity of Product specified in the Confirmed Order.

  • Producer may modify the specifications set forth in this Section 3.4 upon no less than 60 days written notice to Gavilon, provided that the specifications of Product that is the subject of a Confirmed Order may only be modified upon mutual written agreement of Gavilon and Producer.

  • To the extent that any terms of any Confirmed Order conflict with the terms of this Agreement, the terms of this Agreement shall govern, unless, both Parties have specifically expressed their intent in writing to supersede the terms of this Agreement.


More Definitions of Confirmed Order

Confirmed Order shall have the meaning set forth in Section 3.3.2.
Confirmed Order means an order for a Broadband Service made by an Eligible USO Customer which is communicated to BT by any method of communication, including by telephone, letter, email or webchat;
