To the extent (i) the City exercises Flow Control over its Committed City Waste, and (ii) the Committed City Waste does not include Construction and Demolition Wastes, then the City’s Franchised Hauler(s) shall have duly approved and executed the Franchised Hauler’s Agreement to be bound by the City’s Waste Delivery Agreement in the form attached hereto as Exhibit C.
This practice is also in line with article 26 of the Regulation on Control of Excavated Soil, Construction and Demolition Wastes which states that the excavated soil other than the topsoil should be first used as a filling material, for recreational purposes, as a cover soil in landfills and for similar purposes and should be stored for final disposal if reuse is not possible.
Construction and Demolition Wastes mean wood, wallboard, metal, glass, paper, plastic, concrete and other recyclable and non-recyclable solid wastes, including mixed waste, generated by residential, commercial and industrial demolition, remodeling, and construction activities.
