Cure Schedule definition

Cure Schedule means the schedule setting forth the Cure Amount, if any, for each Executory Contract and Unexpired Lease to be assumed pursuant to the Plan.

Cure Schedule means the schedule of proposed Cure amounts for (i) any Executory Contract proposed to be assumed for which the Debtor proposes a Cure amount other than $0.00 and (ii) each Unexpired Lease proposed to be assumed, as the same may be amended, modified, or supplemented from time to time and which will be included in the Plan Supplement.

Cure Schedule means the schedule of proposed Cure amounts for (i) any Executory Contract proposed to be assumed for which the Debtor proposes a Cure amount other than $0.00 and (ii) each Unexpired Lease proposed to be assumed, which will be included in the Plan Supplement.

Examples of Cure Schedule in a sentence

• Any party that fails to object to the applicable Cure Amount listed on the Cure Schedule within twenty (20) days of the filing thereof, shall be forever barred, estopped and enjoined from disputing the Cure Amount set forth on the Cure Schedule (including a Cure Amount of $0.00) and/or from asserting any Claim against the applicable Debtor arising under section 365(b)(1) of the Bankruptcy Code except as set forth on the Cure Schedule.

• The listing of a document on any Cure Schedule shall not constitute an admission by the Debtor that such document is an executory contract or an unexpired lease or that the Debtor have any liability thereunder.

• The Debtor shall provide notice of any amendments to any Cure Schedule to the parties to the executory contracts and unexpired leases affected thereby.

• For the avoidance of doubt, if an Executory Contract between the Debtor and any non-Debtor counterparty is not listed on either (a) the Schedule of Rejected Executory Contracts and Unexpired Leases or (b) the Cure Schedule as an assumed Executory Contract with a proposed Cure amount, then the Debtor intends to assume such Executory Contract and asserts that the Cure amount for such Executory Contract is $0.00.

• The Debtor shall file the Cure Schedule on or before the date that is fifteen (15) days prior to the Confirmation Hearing.
