Damage to water definition

Damage to water infrastructure: This Agreement shall terminate where, in Sunwater's reasonable opinion, Sunwater is no longer able to control the diversion of water to the Distribution Network or control water within the Distribution Network, including meeting demands for taking water, because the Distribution Network, Sunwater Distribution Works or water infrastructure of the holder of a Resource Operations Licence are substantially destroyed or damaged. As soon as is reasonably practicable after ▇▇▇▇▇▇▇▇ has formed that opinion, Sunwater shall notify you and this Agreement shall terminate from the date stated in the notice to you.
Damage to water means any damage that significantly affects the ecological, chemical and / or ecological potential as defined in the WrFD. “Water” refers to all waters covered by the WrFD. “Damage” includes damage to natural resources and / or services.
Damage to water infrastructure: This Agreement shall terminate where, in FCRC's reasonable opinion, FCRC is no longer able to control the level of water in or the rate of release from the relevant water infrastructure because the FCRC Works or water infrastructure of the holder of another Resource Operations Licence are substantially destroyed or damaged. As soon as is reasonably practicable after FCRC has formed that opinion, FCRC shall notify you and this Agreement shall terminate from the date stated in the notice to you.

Related to Damage to water

  • Direct Damage has the meaning given in clause 24.2; "Dispute" has the meaning given in clause 23.1;

  • Damage to Property means physical injury to or destruction of tangible property, including the loss of its use. Tangible property includes the cost of recreating or replacing stocks, bonds, deeds, mortgages, bank deposits and similar instruments, but does not include the value represented by such instruments.

  • Loss or Damage means any loss or damage to the Vehicle, including that caused by theft of the Vehicle or by adverse weather events, that requires repair or replacement including the loss of use of the Vehicle (demurrage), legal expenses, assessment fees, towing and recovery costs, storage, service charges and any appraisal fees of the Vehicle;

  • Injury/Injured means a bodily injury caused by an accident occurring while the Insured’s coverage under this Policy is in force and resulting directly and independently of all other causes of Loss covered by this Policy. The injury must be verified by a Physician.

  • Punitive Damages are those damages awarded as a penalty, the amount of which is neither governed nor fixed by statute.
