Deemed Qualified definition

Deemed Qualified any Teacher who with his/her consent is assigned by the Principal, with the approval of the Board, with due regard for the safety and welfare of the pupils and the provision of the best possible program, shall be deemed qualified consistent with Regulation 298 under the Education Act.
Deemed Qualified means the employee is considered as having the ability, knowledge and skill to fill the normal requirements of the job, subject to him successfully completing the training required to obtain such ability, knowledge and skill.‌ Where practicable, the Company shall train the successful applicant either prior to or at least concurrently with the additional employee so assigned. Where it is preferable to the successful applicant, rather than train him concurrently with such additional employee, he shall be deemed qualified to fill a vacancy posted pursuant to Clause 15.10. Where he is the successful applicant for such vacancy, or at such earlier time as is mutually agreed to by the employee and his supervisor, the Company will provide him with the training and provided he successfully completes such training, assign him to the vacancy. Where he does not successfully complete such training, he shall be reassigned to his regular occupational classification which shall have been considered a Temporary Vacancy for the period of his training. In the event that the successful applicant for a trainee job, prior to being trained, is to be laid off pursuant to Clause 15.12, or transferred out of a Department pursuant to Clause 15.04, or demoted pursuant to Clause 15.08, then, provided being successfully trained will result in him not being so laid off or so transferred, or will result in him being demoted to an occupational classification more favourable to him, the Company shall provide him with the training as soon as practicable. Where he does not successfully complete such training, he shall be laid off pursuant to Clause 15.12, or transferred out of a Department pursuant to Clause 15.04, or demoted pursuant to Clause 15.08.‌ If the employee refuses to accept training or otherwise fails to successfully complete the training in an occupational classification for which he is deemed qualified, he shall forfeit his right to be trained in that occupational classification until he shall again have been the successful applicant for a training job in that occupational classification posted pursuant to this Clause 23.03. No employee shall be eligible to be assigned such “trainee jobs”,‌
