Foreign person definition

Foreign person means any person (including any individual, partnership, corporation, or other form of association) other than a United States person.

Foreign person means — (i) a natural person not ordinarily resident in Australia; (ii) a corporation (other than a Foreign Corporation) in which a natural person not ordinarily resident in Australia or a Foreign Corporation holds a controlling interest; (iii) a corporation (other than a Foreign Corporation) in which 2 or more persons, each of whom is either a natural person not ordinarily resident in Australia or a Foreign Corporation, hold an aggregate controlling interest; or (iv) a Foreign Corporation; PROVIDED HOWEVER that — (A) a corporation incorporated in Australia and having its shares listed for quotation in the official list of a stock exchange in Australia and which is the registered holder or the beneficial owner of not more than one per centum (1%) of all Units for the time being created and not cancelled; (B) a corporation incorporated in Australia which is the registered holder or beneficial owner of not more than one quarter of one per centum (¼%) of all Units for the time being created and not cancelled shall not be, for the purposes of this Agreement, a Foreign Person unless the Minister deems it to be a Foreign Person.
