Deficient Product definition

Deficient Product has the meaning specified in Section 6.1(a);
Deficient Product shall have the meaning set forth in Section 10.4.1(v).
Deficient Product means Products, Promotional Samples and Clinical Samples not conforming to the warranty assumed by Nycomed pursuant to Section 10.4.1 (i)-(iv), and the terms "Deficiency" or "Deficient" shall refer to any deficiency covered by Nycomed's warranty pursuant to Section 10.4.1 (i)-(iv).

Examples of Deficient Product in a sentence

  • Buyer shall bear all costs of shipment and transportation related to the repair or replacement of Deficient Product.

  • K2 shall, at its sole option and discretion, either repair or replace with a comparable product, or refund Buyer’s purchase price of, a Deficient Product (“Remedy”).

  • To the extent that a Recall results from, or arises from Deficient Product, Patheon will be responsible for the reasonable documented costs and expenses of the Recall including, without limitation, reasonable attorney’s fees, and will, at Client’s sole option, either (i) use commercially reasonable efforts to replace the Deficient Product with replacement Products as per Section 10, or (ii) refund all amounts paid by Client in respect of the Deficient Product.

  • Client will not dispose of any damaged, returned, or Deficient Product for which it intends to assert a Product Claim against Patheon without Patheon’s prior written authorization to do so.

  • In any Year, in addition to the specific remedies under Section 10.2(a) for Deficient Product, [***],Patheon’s [***] under or in connection with this Agreement or any Product Agreement (however arising, including contract, tort, negligence, indemnity, breach of statutory duty, losses of DS, or otherwise) [***].

  • If the Product is eventually not considered a Deficient Product either by agreement among the Parties or as the outcome of the Technical Dispute, Purchaser will bear the cost of return and disposition thereof.

  • If Buyer terminates this Contract under Section 10 of the Base Contract as the result of an Event of Default, then any Deficient Product for which Replacement Product was Delivered or payment made to Buyer in accordance with this Section shall not be included in the calculation Buyer’s termination damages for purposes of Section 10.3 of the Base Contract.

Related to Deficient Product

  • Final Product means a product that is not used in producing other products and is built and intended for use outdoors, provided the final product has not deteriorated or has otherwise become a potential source of contaminants.

Unless a product is considered a milk product under this subdivision, milk product does not include dietary products, infant formula, ice cream or other desserts, cheese, or butter. Milk products include the following:

  • Manufacturing Site means a location where a manufacturing

  • Generic Product means a product which (a) contains as its active pharmaceutical ingredient a compound that is (or is substantially the same as) the Licensed Compound or the active pharmaceutical contained in a Unity Bcl-2 [***] Product, and (b) has been placed on the market pursuant to a validly granted marketing authorization.

  • complex product means a product which is composed of multiple components which can be replaced permitting disassembly and re-assembly of the product.

  • Finished Product means a cannabis product in its final form to be sold at a retail premises.

  • End product means those articles, materials, and supplies to be acquired under the contract for public use.

  • Aerosol product means a pressurized spray system that dispenses product ingredients by means of a propellant contained in a product or a product's container, or by means of a mechanically induced force. “Aerosol Product” does not include “Pump Spray.”

  • Approved Product means any water fitting, plumbing product, material or component which is the subject of an existing WRAS Approval;

  • Replacement Product means electric generating capacity, capacity-related benefits, environmental attributes, Energy or other electric products from a generation resource other than the Facility that are provided or delivered to replace or substitute for Contract Capacity or Storage Capacity (or any Capacity-Related Benefit, Environmental Attribute, Other Electric Product, Contract Energy, or Storage Energy associated therewith), in each case, in whole or in part, pursuant to Section 4.6.

  • Hemp product means the same as that term is defined in § 3.2-4112.

  • Edible cannabis product means cannabis product that is intended to be used, in whole or in part, for human consumption, including, but not limited to, chewing gum, but excluding products set forth in Division 15 (commencing with Section 32501) of the Food and Agricultural Code. An edible cannabis product is not considered food, as defined by Section 109935 of the Health and Safety Code, or a drug, as defined by Section 109925 of the Health and Safety Code.

  • Diagnostic Product means In Vitro Diagnostics, In Vivo Diagnostic Agents and any product used for Diagnosis.

  • Marihuana-infused product means a topical formulation, tincture, beverage, edible substance, or similar product containing marihuana and other ingredients and that is intended for human consumption.
