Section 10.4.1. 43 Seniority rights shall not be lost for the following reasons, without limitation:
Section 10.4.1. If no qualified employee from a classification applies for a position, District seniority will 35 always be considered, but ability to perform the duties of the job position shall remain the 36 primary consideration for hiring. 37
Section 10.4.1. If the facility use overtime is related to grounds work, the overtime will first 29 be offered to Grounds employees on the basis of seniority. If no Grounds employees accept 30 the overtime, the overtime will be offered to all Maintenance/Operations employees on the 31 basis of seniority. Section 10.4.1. 18 An employee will be granted subpoena leave with pay when it is within the realm of their 19 employment with the District and they are subpoenaed on the District’s behalf.
Section 10.4.1. 35 Seniority rights shall commence with the employee’s date of hire into the Nutrition Services 36 Department. 37
Section 10.4.1. Employees, when injured on the job, may elect to use any accumulated sick leave time to 47 receive their normal salary. Payments from the Self-Insured Workers’ Compensation Pool may 48 be turned over to the District. The payments turned over to the District will restore the 1 accumulated leave credits in proportion to the amount of the payment. Sick leave pay shall be 2 integrated with any health and welfare plan, income benefit, or State Xxxxxxx’x Temporary 3 Disability Compensation schedule of benefits, so that the sum of the daily sick leave allowance 4 hereunder, and the aforesaid Health and Welfare Plan, accident and sickness income benefit, or 5 State Disability daily benefits, shall not exceed one-hundred percent (100%) of the regular 7 by the employee by reason of any such reduction shall be retained in the employee’s sick leave 8 pay account as part of the employee’s accumulated sick leave pay credits.
Section 10.4.1. 2 Employees granted a leave of absence due to on-the-job injury shall continue to accrue 3 seniority. Employees on leave of absence for other reasons shall not accrue additional seniority 4 but shall retain their accrued seniority.
Section 10.4.1. 21 This Section is included in the Collective Bargaining Agreement for information and illustrative 22 purposes only. It is not subject to the grievance procedure. 24 An employee can calculate their benefit FTE using the following formula. The formula is based 25 upon an employee's regular assignment in terms of regular hours per day and regular compensated 26 days per year.
Section 10.4.1. 31 Employees who change job classifications within the bargaining unit shall retain their hire 32 dates in the previous classification for a period of one (1) year, notwithstanding that they have 33 acquired a new hire date and a new classification.
