MEC shall deliver to Distributor Products with at least six (6) months or fifty percent (50%) of each Product’s shelf life remaining at the time of delivery or such other period as may be agreed to between MEC and Distributor with respect to any specific Products.
The warranty set forth in clause (iii) above shall not apply to any infringement or violation of any third party’s intellectual property rights by Distributor Products (as defined below), if such infringement or violation would not have occurred in the absence of such combination.
