Where Commercial Viability is dependent upon combining a development with other third party developments or accessing third party facilities or technology, a Domgas Project will not be considered to be Commercially Viable if the Joint Venturers, using all reasonable endeavours, are unable to complete an agreement with that party, on reasonable commercial terms which provides an acceptable rate of return.
Subject to the provisions of clauses 38 and 39 and of this clause, this Agreement shall expire on the later of the date occurring 25 years after date on which the last of the Joint Venturers' proposals submitted pursuant to clause 11 for the Domgas Project shall have been approved or determined pursuant to clause 12.
