Employee Benefit Claims definition

Employee Benefit Claims means all Claims, including accrued but unpaid pension Claims from the Petition Date, for compensation or benefits arising out of the Claimants’ employment with the Debtors, but only to the extent and amount provided for under a written benefit plan sponsored by the Debtors. Workers’ Compensation Claims, Asbestos Claims, and other Claims asserted by current or former employees are not Employee Benefit Claims. Further, any Claim for damages or other relief asserted by a current or former employee that is not for compensation or benefits in an amount permitted pursuant to the Debtors’ written benefit plans is not an Employee Benefit Claim.
Employee Benefit Claims means any Claim by a present or former employee of a Debtor that arises under an Employee Benefit Plan.

  • Pursuant to the Interim Order Granting Motion for Authority to Pay Prepetition Wages and Other Employee Benefit Claims [Docket No. 66] (the “Wages Order”), the Bankruptcy Court granted the Debtors authority to pay or honor certain prepetition obligations for wages, salaries, and other compensation, and employee medical and similar benefits.
