Settlement Payments definition

Settlement Payments has the meaning set forth in Section 1.4(h).

Settlement Payments means payments by certain insurance companies pursuant to settlement agreements entered into by UTC and various subsidiaries, including the Company, with insurers under which the parties settled claims of UTC and various subsidiaries, including the Company and certain of the Subsidiaries, for coverage for environmental liabilities and losses under certain general liability and property policies.

Settlement Payments means a payment to an Authorized Claimant or payments to Authorized Claimants from the Net Cash Fund as described under Section 2.1(d) of this Settlement Agreement.

Examples of Settlement Payments in a sentence

• The Parties agree that $50,000 of the Maximum Settlement Amount will be allocated to settle the PAGA claim, and will be distributed as follows: seventy- five percent (75%) of the apportioned PAGA settlement amount ($37,500) will be paid to the LWDA, and the remaining twenty-five percent (25%) ($12,500) will be divided among the PAGA Members as described below and included in their Individual Settlement Payments.

• Allocation of Settlement Payments 3 Individual Settlement Payments to each Participating Class Member shall be allocated as 4 follows: twenty percent (20%) shall be attributed to wages, to be reported on a W-2 form by the 5 Settlement Administrator, and eighty percent (80%) as penalties, interest, and non-wage damages, 6 to be reported on an IRS Form 1099 (if applicable) by the Settlement Administrator.

• The Settlement Administrator shall, under the supervision of the Court, administer the relief provided by this Agreement by processing Claim Forms in a rational, responsive, cost effective and timely manner, and calculate Settlement Payments in accordance with this Agreement.

• If ten percent (10%) or more of the Class Members, or a number of Class Members whose Individual Settlement Payments represent ten percent (10%) or more of the total of all Individual Settlement Payments, validly elect not to participate in the Settlement, Xxxxxxx will have the right to rescind the Settlement, and the Settlement and all actions taken in its furtherance will be null and void.

• The Settlement Administrator shall make all Settlement Payments contemplated in Section IV.1(a)-(e) of this Agreement by either electronic means or check and send them to Participating Settlement Class Members within thirty (30) days after (i) the Effective Date; or (ii) all Claim Forms have been processed subject to the provisions of Section IV of this Agreement, whichever date is later.

Settlement Payments has the meaning ascribed thereto in Section 6.01.

Settlement Payments means settlement payments made to the State or itsSubdivisions pursuant to the National Settlement Agreement.

Settlement Payments means payments by the Borrower of approximately $2.775 billion to asbestos and silica claimants as described in the Disclosure Statement.
