Excess Production definition

Excess Production has the meaning set out in Section 4.5(3).
Excess Production means, with respect to a Quarter, the amount, if any, by which Actual Production (excluding any amounts which ELP rejected in accordance with Section 6.2 of the Terminal Services Agreement) exceeds Forecast Production.
Excess Production means, in respect of each Calculation Period, any production of consumer grade dry finished cannabis flower from the Natura Facilities as set forth in the applicable Production Statement during such Calculation Period in excess of 2,250 kilograms.

  • In no event shall Assignee be liable or responsible in any way for any Production Costs (including Excess Production Costs) or other costs or liabilities incurred by Assignor or others attributable to the Subject Interests or to the Hydrocarbons produced therefrom.

  • Notwithstanding the foregoing, and for purposes of clarity, nothing in this Section 4a shall be deemed to affect the “as is, where is” nature of the assignment herein, as contemplated by Section 3f above, and Assignee is taking the Specified Interest subject to all terms of the Conveyance, including, without limitation, being subject to Excess Production Costs (as such term is defined in the Conveyance) existing as of the Effective Date.

  • The Transferred Overriding Royalty Interest is assigned hereby and accepted by Assignee subject to carried-forward Excess Production Costs, as defined in the Conveyance, whether attributable to periods before, on or after the Effective Date, proportionately reduced, when applicable, attributable to or relating to the Transferred Overriding Royalty Interest.

  • Excess property means property under the control of any Federal awarding agency that, as determined by the head thereof, is no longer re- quired for its needs or the discharge of its responsibilities.

  • Recycled product means a product containing recovered material, or post-consumer recovered material, or both.

  • Refined Products means gasoline, diesel fuel, jet fuel, asphalt and asphalt products, and other refined products of crude oil.

(Note: Definitions of excess emissions under 02D .1110 and 02D .1111 shall apply where defined by rule.)

  • Aerosol cooking spray means any aerosol product designed either to reduce sticking on cooking and baking surfaces or to be applied on food, or both.
