Eligible Projects. Eligible Projects are those that fit within an Eligible Investment Category. Eligible Investment Categories are listed in Schedule A.
Eligible Projects. Costs directly and reasonably incurred by the Recipient for construction, renewal, renovation or redevelopment or material enhancement activities funded under existing Community Improvement Plan financial incentive programs or activities funded under the Municipal Physical Infrastructure category, including projects in downtown or main street areas, as defined through an existing Community Improvement Plan or other municipal land use planning policy that will support the role of small businesses in main street areas as more specifically described in Schedule B and Schedule C
Eligible Projects. Borrowers must be a “for-profit” business. • Business must be complimentary to existing business community. • Borrowers must have equity injection as determined by fund management.

Eligible Projects. The following is a list of projects that may meet the Qualifying Parameters under Category II. This list is not inclusive of every project and there may be projects not listed below that meet the Qualifying Parameters and can be proposed by MDOT SHA and reviewed by CAC under Category II. ● Category I projects that fail to meet Category I threshold limits. ● Buildings/structures - new, expansion of existing, replacement, relocation, in-kind, etc. ● Repairs to or replacement of truck weigh stations, salt domes, rest areas, or MDOT SHA installations. ● New/Replacement shore erosion control measures (revetment, bulkheads, living shorelines). ● Installation of new or modification of existing storm drain outfalls ● Installation of new or modification of existing inlets and storm drains ● Installation of new bicycle lanes (except for multi-use paths - see Special Projects) or sidewalks ● Reconstruction, patching, and/or resurfacing of roadways, intersections, bicycle facilities, parking lots, and/or sidewalks where an increase in imperviousness is proposed. ● Unimproved stone/asphalt shoulder - conversion to paved shoulder where ground disturbance is proposed. ● Widening of shoulder (permanent). ● Replacement of impervious surfaces with permeable surfaces. ● Upgrades to existing facilities in order to meet requirements for Americans with Disabilities Act. ● Reconstruction of existing sidewalks and new or existing ADA ramps with more than 250 sq ft of new imperviousness. Eligible Projects. The Borrowers shall from time to time designate Facilities owned by any of the Borrowers as Eligible Projects included in the Borrowing Base pursuant to the terms hereof. The Facilities which are currently Eligible Projects are listed on EXHIBIT C attached hereto and incorporated herein by reference or any future Borrowing Base Report. The Credit Facility shall be secured by (a) the first lien Deeds of Trust on the fee simple interests of the Borrowers in the Eligible Projects or on the leasehold interests of Borrowers under Qualified Ground Leases, (b) a first lien security interest in all fixtures, building materials and all other machinery, equipment and other personalty used or installed by the Borrowers or each of the premises of an Eligible Project or in the Improvements constructed thereon, and (c) all of the other Collateral relating to the Eligible Projects. The Borrowers may release an Eligible Project from the lien of its Deed of Trust at any time provided no Event of Default has occurred and is continuing and provided at least six (6) Eligible Projects remain in the Borrowing Base upon payment of any Borrowing Base Deficiency which would result from such release and certification that the remaining principal sum outstanding does not exceed then current availability from the Eligible Projects remaining in the Borrowing Base. In addition, the Borrowers may exclude an Eligible Project from the calculation of the Borrowing Base without releasing it from the lien of its Deed of Trust at anytime provided at least six (6) Eligible Projects remain in the Borrowing Base; provided, however, that all covenants and conditions set forth in this Agreement shall continue to apply to such Eligible Project unless expressly otherwise agreed in writing by the Administrative Agent or as otherwise provided in ARTICLE IX (Events of Default) hereof. The Administrative Agent may in its sole discretion agree to include a Facility occupied pursuant to a Qualified Ground Lease; provided, however, that at no time shall Eligible Projects subject to Qualified Ground Leases, plus Accommodator Eligible Projects subject to Qualified Ground Leases which are not a Sunrise Qualified Ground Leases (as defined in the Accommodator Financing Agreement) comprise more than twenty percent (20%) of the maximum availability under the Borrowing Base under this Credit Facility at any one time.
Eligible Projects. In order for any Project to be deemed an Eligible Project for purposes of this Agreement, either such Project must be listed on Schedule A hereto or Borrowers shall deliver a certificate, satisfactory in form and substance to Lender, to Lender certifying that all of the requirements set forth as items 1 and 2 in Schedule 5.17 are satisfied with respect to such Project. Any Project not listed on Schedule A hereto shall be deemed for all purposes hereunder to be an “Eligible Project” only upon issuance of written confirmation by Lender.

Eligible Projects. Projects to finance the incremental capital and training costs of complying with DOT’s OTRB accessibility rule (49 CFR part 37) are eligible for funding. Incremental capital costs eligible for funding include adding lifts, tie-downs, moveable seats, doors and training costs associated with using the accessibility features and serving persons with disabilities. Retrofitting vehicles with such accessibility components is also an eligible expense. Please see Buy America section for further conditions of eligibility. FTA may award funds for costs already incurred by the applicants. Any new wheelchair accessible vehicles delivered after June 8, 1998, the date that the TEA–21 became effective, are eligible for funding under the program. Vehicles of any age that have been retrofitted with lifts and other accessibility components after June 8, 1998, are also eligible for funding. Eligible training costs are those required by the final accessibility rule as described in 49 CFR 37.209. These activities include training in proper operation and maintenance of accessibility features and equipment, boarding assistance, securement of mobility aids, sensitive and appropriate interaction with passengers with disabilities, and handling and storage of mobility devices. The costs associated with developing training materials or providing training for local providers of OTRB services for these purposes are also eligible expenses. FTA will not fund the incremental costs of acquiring used accessible OTRBs that were previously owned, as it may be impossible to verify whether or not FTA funds were already used to make the vehicles accessible. Also, it would be difficult to place a value on the accessibility features based upon the depreciated value of the vehicle. The legislative intent of this grant program is to increase the number of wheelchair accessible OTRBs available to persons with disabilities throughout the country. The purchase of previously-owned accessible vehicles, whether or not they were funded by FTA, does not further this objective of increasing the number of wheelchair accessible OTRBs.
