Eligible Projects. Costs directly and reasonably incurred by the Recipient for construction, renewal, renovation or redevelopment or material enhancement activities funded under existing Community Improvement Plan financial incentive programs or activities funded under the Municipal Physical Infrastructure category, including projects in downtown or main street areas, as defined through an existing Community Improvement Plan or other municipal land use planning policy that will support the role of small businesses in main street areas as more specifically described in Schedule B and Schedule C

Eligible Projects. Eligible Projects are those that fit within an Eligible Investment Category. Eligible Investment Categories are listed in Schedule A.
Eligible Projects. This category includes maintenance projects which exceed the thresholds of Category I projects as well as new minor construction projects. If required, stormwater management measures must be sufficient to achieve a 10% reduction in pollutant loadings below existing levels. Category II projects must be individually submitted to Commission staff for concurrence as a minor project. Comments from Commission staff must be received and addressed before the activity is commenced. The following is a list of projects that may meet the Qualifying Parameters under Category II. This list is not inclusive of every project and there may be projects not listed below that meet the Qualifying Parameters and can be proposed by HSMCC and reviewed by CAC staff under Category II. STRUCTURAL AND FACILITY PROJECTS (10% required) • New buildings and structures • Expansion or replacement of existing buildings and structures DRAINAGE IMPROVEMENTS (10% not required) • Installation of new or modification of existing storm drain outfalls • Installation of new or modification of existing inlets and storm drains • Installation of new or modification of existing culverts SHORE EROSION CONTROL (10% not required) • New or replacement shore erosion control measures (e.g., revetments, bulkheads, living shorelines) ROADWAY, PARKING AND SIDEWALK PROJECTS (10% required) • Reconstruction or resurfacing of roadways, parking lots, and/or sidewalks where an increase in imperviousness is proposed • Upgrades to existing facilities to meet requirements of Americans with Disabilities Act (ADA) • Reconstruction of existing sidewalks and new or existing ADA ramps • Reconstruction, patching, and/or resurfacing of intersections, roads, parking lots, sidewalks, bicycle facilities or other surfaces where there is an increase in imperviousness or that does involve the conversion of one type of impervious to another UTILITIES (electric, sewer, water, telephone, and fiber optic lines) (10% not required) • Installation of new utility lines • Replacement of existing utility lines when serving new development • Replacement of access crossings • Replacement of utility crossings PIER AND PILES (10% not required) • New pier and piles (MDE or Board of Public Works authorization is required) NONSTRUCTURAL/RESTORATION PROJECTS (10% not required) • Clearing/Removal of more than five (5) hazardous trees • Streambank stabilizationWetland creation and waterfowl impoundment construction, provided that no Habitat Protectio...

Eligible Projects. The Borrowers may from time to time with the consent of the Lenders designate a Facility owned by a Borrower or a Synthetic Lease Transaction as an Eligible Project to be included in the Borrowing Base pursuant to the terms hereof. The Facilities which are then Eligible Projects shall be listed on any future Borrowing Base Report. The Obligations shall be secured by all of the following property and assets of each Borrower, each Synthetic Lessee, ARC or any Affiliate, wherever situated with regard to each of the Eligible Projects: (a) a Deed of Trust on the fee simple interest held by the applicable Borrower in the premises of such Eligible Project and all other Improvements now or hereafter located thereon; or an assignment of an Assigned Note and the related Note Collateral pertaining to such Eligible Project which is the subject of a Synthetic Lease Transaction; provided that ARC will provide to the Agent for the benefit of the Lenders as additional Collateral for the applicable Assigned Note a first lien deed of trust on its fee ownership of any Eligible Project that is the subject of a Ground Lease in connection with a Synthetic Lease Transaction (each a "Fee Interest Deed of Trust" as it may from time to time be amended, restated or substituted); (b) a first lien security interest in all fixtures, building materials and all other machinery, equipment and other personality used or installed by any Borrower or the Synthetic Lessors or Synthetic Lessees on the premises of such Eligible Project or in the Improvements constructed thereon; and (c) all of the other Collateral relating to such Eligible Project. In connection with a Synthetic Lease Transaction the collateral described in (b) and (c) above may be assigned through and in connection with the assignment to the Agent of the Note Collateral. The Borrowers may obtain the release of an Eligible Project and all Collateral associated therewith from the liens of the applicable Deed of Trust or assignment of Assigned Note, Collateral Assignments, Security Documents and other Financing Documents at any time provided no Default or Event of Default has occurred and is continuing or would occur as a result of such release and provided that the provisions of Section 2.1 (c) and Section 7.2.1 are satisfied and provided that the Borrowers pay any resulting Borrowing Base Deficiency before or contemporaneously with any such release.
Eligible Projects. The Foundation shall disburse the Amount by providing funding to Eligible Recipients in respect of the Eligible Costs for Eligible Projects. Eligible Projects. In order for any Project to be deemed an Eligible Project for purposes of this Agreement, either such Project must be listed on Schedule A hereto or Borrowers shall deliver a certificate, satisfactory in form and substance to Lender, to Lender certifying that all of the requirements set forth as items 1 and 2 in Schedule 5.17 are satisfied with respect to such Project. Any Project not listed on Schedule A hereto shall be deemed for all purposes hereunder to be an “Eligible Project” only upon issuance of written confirmation by Lender.
