Exclusion of Warranty. The Company does not represent, and hereby excludes any warranty, that the online event will be attended any specific number of website users or persons, or that the results of such event will yield any specific number of leads, or leads of any specific type. Any projections or forecasts of attendees or leads are estimate only and are non-binding.
Exclusion of Warranty. The Landlord does not warrant or represent that the Premises may be used for the Permitted Use or for any other purpose.
Exclusion of Warranty. Nothing contained in this Lease or in any consent granted or approval given by the Lessor under it implies or warrants that the Leasehold Area may be used under the Planning Acts for the purpose herein authorised or any purpose subsequently authorised and the Lessee hereby acknowledges that the Lessor has not given or made, at any time, any representation or warranty that any such use is or will be or will remain a permitted use under the Planning Acts.
Exclusion of Warranty. The above Limited Warranty will not apply if: (i) the Software is not used in accordance with this Agreement or the Documentation; (ii) the Software or any part thereof has been modified by any entity other than McAfee; or (iii) a malfunction in the Software has been caused by any equipment or software not supplied by McAfee.
Exclusion of Warranty. To the full extent permitted by law, HP excludes all representations, warranties, terms and conditions, whether express or implied (and including those implied by statute, custom, law or otherwise), except as expressly set out in this Agreement, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
Exclusion of Warranty. In deviation of section 7.1 above, Service Provider herewith, except for fraudulently concealed Defects, excludes any and all representations, warranties, and, guarantees, conditions, and representations, whether oral or written, expressed or implied, or arising by usage of the Services, including, but not limited to, non-infringement, the merchantability of the Services, its fitness for a particular purpose, meeting Customer`s requirements, or satisfactory quality. Service Provider does not warrant any availability of the Services or that the Services will be provided uninterrupted or free of defects in material or title. Service Provider does not warrant that the Services do not cause any loss or damages resulting from the transfer of data over communication networks or facilities.
Exclusion of Warranty. The Limited Warranty shall not apply if:
(a) The Software is not used in accordance with this Agreement or Documentation;
(b) The Software or any part of the Software has been modified by any individual or entity other than Quick Heal;
(c) A malfunction in the Software has been caused by any equipment or software not supplied by Quick Heal or incompatibility caused by hardware and software components installed on Your device / computer.
Exclusion of Warranty a) If Customer fails to procure log data, or if Product is installed in the environment with no internet connection, thereby rendering the Product offline, any repair or replacement of such Product shall be at Customer’s cost. For the avoidance of any doubt, this Limited Warranty shall not apply in the aforementioned circumstances. Failure of procuring log data will be such as loss of web connection and/or saving data to Product as Q CELLS required.
b) Q CELLS shall not be liable for indirect, incidental, consequential or special damages, howsoever caused, including, but not limited to, loss of use, loss of profits, loss of production, or loss of revenues.
c) Other costs incidental to handling of defective Product, including, but not limited to, labor costs during the installation or disassembly for repair or replace Product, shall be borne by Customer.
d) Q CELLS’s aggregate liability regarding each defective Product, if any, in damages or otherwise, shall not exceed one hundred percent (100%) of the invoice value as paid by the Customer per unit of defective Product. In the event the Customer is unable to provide the invoice, thereby the invoice value cannot be clearly determined, the original price that Q CELLS sold the defective Product at issue to the Distributor shall be the invoice value for the purpose of this Clause 7.d.
e) The terms of this Limited Warranty are expressly in lieu of and exclude all other express or implied warranties, including, but not limited to, warranties of non-infringement, merchantability, fitness for particular purpose, use or application, and all other obligations or liabilities on the part of the Q CELLS, unless such other obligations or liabilities are expressly agreed to in writing signed and approved by Q CELLS.
f) For the sake of clarity, any defect found in the components other than battery module will not be covered under the Performance Warranty, but will be exclusively handled in accordance with Clause 3 of this Limited Warranty, Product Warranty. Furthermore, any claims or demands by Customer based upon deficiencies in Performance Warranty by reason of failures in the components other than battery capacities (or battery SOH) will not be honored, and will be rejected after the expiration of period specified in Clause 3 of this Limited Warranty.
g) Q CELLS shall not be liable for any issues arising out of removal, installation or disassembly of Product.
Exclusion of Warranty. NOTWITHSTANDING SECTION 7.1 ABOVE, SERVICE PROVIDER HEREWITH, EXCEPT FOR FRAUDULENTLY CONCEALED DEFECTS, EXCLUDES ANY AND ALL REPRESENTATIONS, WARRANTIES, AND, GUARANTEES, CONDITIONS, AND REPRESENTATIONS, WHETHER ORAL OR WRITTEN, EXPRESSED OR IMPLIED, OR ARISING BY USAGE OF THE SERVICES, INCLUDING, BUT NOT LIMITED TO, NON-INFRINGEMENT, THE MERCHANTABILITY OF THE SERVICES, ITS FITNESS FOR A PARTICULAR PURPOSE, MEETING CUSTOMER`S REQUIREMENTS, OR SATISFACTORY QUALITY. SERVICE PROVIDER DOES NOT WARRANT ANY AVAILABILITY OF THE SERVICES OR THAT THE SERVICES WILL BE PROVIDED UNINTERRUPTED OR FREE OF DEFECTS IN MATERIAL OR TITLE. SERVICE PROVIDER DOES NOT WARRANT THAT THE SERVICES DO NOT CAUSE ANY LOSS OR DAMAGES RESULTING FROM THE TRANSFER OF DATA OVER COMMUNICATION NETWORKS OR FACILITIES.
