Excused Event definition

Excused Event means any of the following, regardless of the reason for the occurrence thereof:
Excused Event has the meaning set forth in Section 3.16.
Excused Event means (a) Buyer’s failure to cause Gas to be available to Seller at the Gas Delivery Point, (b) the Buyer’s failure to take Energy from and after the Electrical Delivery Point, and (c) an event of Force Majeure that is claimed by Buyer.

Examples of Excused Event in a sentence

  • Within two (2) business Days from the beginning of any delay resulting from a potential Force Majeure Excused Event, the Contractor shall provide a detailed written notice to the Owner of the cause(s) of such delay.

  • If a Force Majeure Excused Event has occurred, the Contractor shall be entitled to a Time Change only.

  • If the Parties do not agree that a Force Majeure Excused Event has occurred, the burden of proof shall rest with the asserting Party.

  • Such delays shall include, but not be restricted to, acts of neglect by any separate Contractor employed by the Town, or Force Majeure Excused Event.

  • If the Contractor is delayed at any time in the commencement or progress of the Work by an act or neglect of the Town or Engineer, or of any employee of either, or of a separate contractor employed by the Town; or by changes ordered in the Work; or Force Majeure Excused Event; or by other causes that the Engineer determines may justify delay, then the Contract Time shall be extended by Change Order for such reasonable time as the Town may determine.

Excused Event has the meaning set forth in Exhibit M.
Excused Event means any Acts of God, declared state of emergency or public health emergency, pandemic (specifically including COVID-19), government mandated quarantines and isolations, war, acts of terrorism, organized labor activities, natural disasters, and/or government mandated orders for civil or military authorities any or all of which would either hinder the Seller’s or the Buyer’s performance under this Agreement and/or make such performance impractical and/or impossible. If an Excused Event occurs to the Seller or the Buyer, as the case may be then the Seller or the Buyer (as applicable) shall provide notice to the other of such Excused Event as soon as practical and the Seller or the Buyer (as applicable) shall have the option of:
Excused Event means the time during which (a) Buyer fails to make Charging Energy available to Seller at the Electrical Delivery Point, (b) Buyer fails to take Product from and after the Electrical Delivery Point, and (c) Buyer claims an event of Force Majeure.
Excused Event means (a) a force majeure event, (b) any action or inaction by a governmental authority that affects the availability or performance of a Charger, (c) the unavailability of, or any interruptions in, power supply or the supply of other commodities necessary for the operation of a Charger (other than unavailability solely as a result of a failure by EVgo to pay the applicable supplier), (d) a design error or latent product failure that was not identified during product certification by National Research Test Labs (e.g. Underwriter Laboratories) of a Charger, (e) any systemwide or regional failure or impairment of communications systems that significantly disrupts EVgo’s operation, (f) scheduled maintenance, (g) parts shortages (to the extent that EVgo is managing its inventory in accordance with prudent industry practice and using diligent efforts to mitigate any such shortages) and (h) software updates requiring a shutdown of any Charger (provided that, except in the case of an emergency, EVgo shall use commercially reasonable efforts to schedule any such updates during off-peak hours).
Excused Event means (a) any Force Majeure; (b) any Emergency not caused by the fault or negligence of Supplier; or (c) the inability or failure of Buyer to accept Energy for any reason other than the fault or negligence of Supplier, including as a result of any curtailment resulting from an Emergency declared by MISO, Transmission Provider or the Control Area Operator
Excused Event means a Planned Outage, a Forced Outage, or an Force Majeure Event causing a reduction or suspension of the Water Transportation Services.
Excused Event means a breach of your obligations under this GPA which is either waived
