Extended Cure Period definition

Extended Cure Period. As defined in Section 2.03(b).

Examples of Extended Cure Period in a sentence

• In the event OPM provides the Contractor with an Extended Cure Period within which to cure any breach(es), then, unless otherwise modified in writing by OPM prior to the Extended Termination Date and/or the breach(es) to which the Extended Cure Period apply have been cured within such period, the portion(s) of this Contract to which such Extended Cure Period pertain shall Terminate without any further action by OPM.

• Any Termination effected pursuant to this subparagraph (b)(ii) shall be effected by OPM’s providing the Contractor with written notice of both the extent and the effective date of Termination or, as applicable, if OPM decides to grant the Contractor an Extended Cure Period in which to cure any breach(es), the Extended Termination Date applicable to such Extended Cure Period.

• If the Tenant does not amend the situation that originated the communication during the Extended Cure Period or the Cure Period provided, or gives a satisfactory response to Landlord, at least requesting an extension of the Extended Cure Period or the Cure Period, or if such response is unreasonable, Landlord will be entitled to terminate the Lease Agreement with responsibility for Tenant, and Landlord will have the right to be compensated in accordance with Section 5.01 above.

• During such Extended Cure Period, the Agent shall keep the AEDB apprised of the Lenders’ or their designee’s efforts to cure such Seller Event of Default.

• For the avoidance of doubt, it is understood that with respect to a Qualified Mortgage Material Defect, the Extended Cure Period described in the preceding sentence shall not apply.

Notwithstanding the foregoing, each Extended Cure Period shall extend beyond the nine month period provided for above, provided that, and only for so long as, (i) mining operations continue at the Subleased Property in accordance with the terms of Paragraph 7 hereof and at a rate sufficient enough to cover the then current minimum rentals payable under this Sublease, but in no event less than a rate comparable to the rate which such mining operations were proceeding prior to the applicable default, (ii) Sublessee or the Permitted Mortgagee pays all rent, royalties and other charges accruing hereunder to Sublessor, (iii) Sublessor is not subject to any criminal liability on account of the continuance of such default, and (iv) Permitted Mortgagee provides reasonable security for the civil liability to which Sublessor may be subject on account of the continuation of such default.
