Final Settlement Approval Date means the date thirty-five (35) days after the Court enters the Settlement Order and Judgment on the Parties and all objectors to the Settlement Agreement, if any, without any appeal being taken, or if an appeal or request for review has been taken, the date on which the Settlement Order and Judgment has been affirmed or modified by the court of last resort to which an appeal or request for review has been taken and such affirmance or modification is no longer subject to further appeal or review, or the date of denial of review after exhaustion of all appellate remedies, or the date on which all appellate rights with respect to the Settlement Order and Judgment have expired.

  • Effective as of the Final Settlement Approval Date, all Releasing Parties shall release and forever discharge, and shall be forever be barred from asserting, instituting or maintaining against any or all of the Released Persons or Released Parties, any and all of the Released Claims.
