On October 29, 2019, OSERS released Frequently Asked Questions (FAQs) Prior Approval – OSEP and RSA Formula Grants which details prior approval flexibilities for equipment and participant support costs and describes the parameters under which OSEP has provided prior approval for a subset of these costs.
The federal Office of Juvenile Justice and Delinquency Prevention (OJJDP) provides funding directly to states through its Title II Formula Grants Program (Title II) to support state and local delinquency prevention, intervention efforts and juvenile justice system improvements.
This type of planning is also an eligible activity under four other FTA programs—the Metropolitan Planning (Section 5303), Statewide Planning (Section 5304), Formula Grants for Rural Areas (Section 5311), and Urbanized Area Formula (Section 5307) programs—all of which may be used to supplement the limited (10 percent) planning and administration funding under this program.
To be eligible to receive a Formula Grants Program award, states must satisfy the 28 state plan requirements described at 34 U.S.C. § 11133(a).
This certification does not apply to any applicant that receives financial assistance from FTA exclusively under the Formula Grants for the Enhanced Mobility of Seniors Program (49 U.S.C.§ 5310), the Formula Grants for Rural Areas Program (49 U.S.C. § 5311), or combination of these two programs.
Within the 28 state plan requirements are four requirements that are deemed to be “core” because OJJDP will reduce a state’s annual Formula Grants award by 20 percent for each requirement with which the state is determined to be out of compliance.
The objectives of the Formula Grants for Rural Areas (Section 5311) program are to initiate, improve, or continue public transportation service in rural areas by providing financial assistance for operating, planning, administrative expenses, and the acquisition, construction, and improvement of facilities and equipment.
It is funded as a takedown from funds made available for the Formula Grants for Rural Areas program.
If the applicant will apply for an award under FTA's Fixed Guideway Capital Investment Program (49U.S.C. § 5309), Formula Grants for Rural Areas Program (49 U.S.C. § 5311), or Grants for Buses and Bus Facilities Program (49 U.S.C. § 5339) programs, the applicant must make the following certification.
