Fountain Syrup definition

Fountain Syrup means the post-mix syrup used to prepare Fountain Beverages, but does not include other forms of concentrate, or Breakmate syrup or syrup for frozen beverages that is purchased from a full service supplier of frozen beverages to which CCF provides promotional funding. Rubios will serve in each Covered Outlet a core brand set of Fountain Beverages that consists of Coca-Cola-Registered Trademark- classic, diet Coke-Registered Trademark- and Sprite-Registered Trademark-, and the remaining products will be jointly selected by Rubios and CCF. CCF's Fountain Beverages will be the only Fountain Beverages served in the Covered Outlets. Rubios recognizes that the sale of competitive Beverages in bottles, cans or other packaging would diminish the product availability rights given to CCF, and therefore also agrees not to serve competitive Beverages in bottles or cans in the Covered Outlets.   • For every ten (10) Bag-in-Box containers of Mr. PiBB® Fountain Syrup purchased, CCF will reimburse DRI or the applicable Subsidiary for its cost of purchasing the eleventh Bag-in-Box container of Mr. PiBB®.

  • Notwithstanding the foregoing, if a National Account Customer elects to receive shipments of Fountain Syrup through direct store door delivery ("DSD") in one or more of the Territories, the Company shall appoint the Bottler, and upon appointment the Bottler hereby undertakes to serve, as the Company's exclusive agent in such Territories for the (i) manufacture and packaging of the Fountain Syrups and (ii) distribution of the Fountain Syrup under the Trademarks to such National Account Customer.

  • The Company shall notify the Bottler in writing of such withdrawal, and the Bottler shall, upon receipt of notice, immediately cease distribution of the Fountain Syrup or such package therefor.

  • If any Fountain Syrup distributed by the Bottler is found outside of the Territories in violation of this paragraph 13, Bottler shall be deemed to have transshipped such Fountain Syrup and shall be deemed to be a "Transshipping Bottler" for purposes hereof.

  • If the Company determines the existence of quality or technical difficulties with any Fountain Syrup, or any package used for the Fountain Syrup, the Company shall have the right, immediately and at its sole option, to withdraw the Fountain Syrup or any such package from the market.

  • If so directed by the Company, the Bottler shall recall and reacquire the Fountain Syrup or package involved from any purchaser thereof.

  • DRI agrees that the Covered Outlets will purchase [ * ] gallons of CCF’s Fountain Syrup during the Term (the “Volume Commitment”).

  • For purposes of this Agreement, "Offended Bottler" shall mean a Bottler in any Territories into which any Fountain Syrup is transshipped.
