  • Sandbox shall be solely responsible for the production of any CD-ROM Game Product, including all creative and hard costs associated therewith and all elements thereof, including securing any and all third party rights and compliance with all applicable laws, rules and regulations.

Xxxxx or the agreed upon substitute, if applicable (collectively referred to as the "Dxxx'x XX-Rom Game Products").

  • It is understood by both parties that this Agreement shall supersede the terms and conditions of any and all prior written or oral agreements, commitments, or understandings of the parties relating to the subject matter hereof; and, solely with respect to the Game Product, this Agreement shall supersede and replace the Prior Agreement, which shall terminate upon the execution of this Agreement by both parties.

  • In this regard, Sandbox hereby acknowledges CNNfn's contributions to the initial CD-ROM Game Product, including the appearance of Lxx Xxxxx thereon ("Initial CD-ROM Game Product").

  • Sales of Video, DVD and Game Product shall accrue toward the annual Net Product Purchase volume needed to receive Rebates, however Rebate discounts will be taken on Audio Product only.

  • Notwithstanding the foregoing, a Game Product cannot be added as a Client Provided Game if the applicable Game Product is already available as an lforium Provided Game through the Software and Deliverables.
